The only attack that the RWers have against Sotomayor is her ruling about the firefighters and they add - it will be overturned by the Supreme Court, probably while she is being considered for nomination.

So I looked at Wikipedia report and found this interesting comment:

On appeal, a panel of the Second Circuit Court of Appeals that included Sonia Sotomayor affirmed the district court's ruling, but the court added a per curiam opinion which recommended review by the US Supreme Court. The US Supreme Court agreed to hear the case.
