Sounds like Wal-Fart stupidvisors can't read the Americans with Disability Act. Instead of putting her on "Medical Leave" they should have made some kind of reasonable accomodation. What an evil, evil company...

Anchorage, Alaska - A former Ohio sheriff's deputy turned Anchorage Wal-Mart greeter says she was sent home from work because she asked to sit on a stool.

The 67-year old woman is now suing Wal-Mart after they placed her on un-paid medical leave.

Barbara Flory has worked at the South Anchorage Wal-Mart as a greeter for the past six-and-a-half years, until she was placed on unpaid medical leave in July.

Flory was placed on leave because she asked local managers if she could sit on a stool for a couple of minutes each hour. She says a stroke she suffered 21 years ago paralyzed most of her left side, and doctors told her at the time she would not likely survive.

Twelve years ago she took a job as a greeter in an Ohio Wal-Mart and continued working when she came to Anchorage in 1999.

But recent back trouble requires that she sit down from time to time.

she took the job, she must have known up front the requirements. Now if she had been injured on the job, and was on light duty she might have more leverage.

arguing the morality of this yes I think she could do her job while sitting for parts of it. My point is mainly from whether she has legal grounds which to sue. So please chill.

8. No, it sounds like you are arguing that it serves her right.
Sounds like you agree with Wal Mart, that if they say a greeter has to stand at all times then, dammit, that greeter better be able to stand at all times forever or else they'll find someone who will. Maybe another 61 year old who can stand at all times when she starts the job, out of whom they can get another six good low paid years.

I imagine that her lawyer thinks she has a case or he wouldn't have taken it on. Or maybe he thinks it's worth publicizing the ruthlessness of a company whose policy is to treat their workers with deliberate disdain. Hopefully there are enough Americans left who do think that morality, and ethics, are at least as important as legality.

9. Americans With Disabilities Act
Requires employers to make reasonable accomadations to employees with disabilities. Based on what I've read here, Wal Mart is on thin ice with this one. She doesn't have to be hurt at work. With a doctors recommendation and what seems to be reasonable request I think she'll win.

In our legal system, you just never know. I've seen people I thought were guilty dead to rights get off and I've seen people participating in consensual sex get years in prison. Nothings for certain. It depends on what state you're in and how the judge feels that day when they get out of bed.

be right I am certainly not an attorney. Do you think she made this request upon employment or later. It seems she had this disability before being hired. I have a small business (daycare)and we always ask prospective employees what their physical limitations are.
