Legislators to sue Napolitano on veto
GOP leaders say governor misused power in state employee pay raise

House and Senate leaders said Thursday they will sue Gov. Janet Napolitano for misusing her line-item veto authority.They say their case is about much more than her rejection of a GOP-backed reform measure in a recently approved state employee pay raise. Republican lawmakers believe their constitutional powers have been under assault by Napolitano, who has made enthusiastic use of vetoes and executive orders in her three years in office.
Governors can use the line-item veto to reject individual spending proposals in budget bills. But Napolitano's line-item veto in the pay package did not involve an appropriation, Republicans said Thursday.
"We are not just defending the body of the Legislature, we're defending the Constitution," said Sen. Thayer Verschoor, R-Gilbert. "If we concede to this, we essentially wipe out the need for the Legislature."..."

The vetoed measure would have affected about 200 new hires, as most state workers at higher salaries are political appointees not subject to the merit system.
