Attorney general leaves case of slain S.F. officer with DA

SAN FRANCISCO (AP) - California's attorney general has decided against having the state prosecute a man accused of killing a San Francisco police officer after concluding that District Attorney Kamala Harris acted within her discretion when she opted not to seek the death penalty against the suspect, according to Harris' spokeswoman.
"Based on what he has said over the last few weeks, we know he is not going to take the case," Debbie Mesloh, Harris's spokeswoman, said Tuesday.
Lockyer has scheduled an 11 a.m. news conference to announce the results of the "abuse of discretion" review his office launched at the request of the San Francisco Police Officers Association and a group of 42 state lawmakers.
