Supreme Court last year, that Michael Newdow, the Sacramento atheist behind this suit and an earlier one targeting the pledge, has no standing to sue because he does not have custodial control of a daughter who attends an Elk Grove school. Recitation of the Pledge of Allegiance in a classroom is unconstitutionally coercive, a Sacramento federal judge ruled Wednesday.
Saying he is bound by a 2003 federal appellate opinion, U. S. District Judge Lawrence K. Karlton found teacher-led recitation of the pledge, which contains the words "under God," is a violation of the Constitution’s establishment clause mandating separation of religion and government.
