Amendment 34 . Is this true?

Dreyer said homeowners should also be concerned that Amendment 34 would broaden the state law over what repairs or remodeling work can be the subject of a lawsuit. Under the current law, only professional builders and contractors are subject to lawsuits for defective construction.

"But Amendment 34 opens the door to other work done around a home, meaning that any homeowner could be sued if their remodeling work turns out to be defective by the next buyer," Dreyer said.

A-34 is one confusin' piece of work. I'm also concerned that many small time ma & pa construction companies could be hurt by this. I don't have a problem going after those fuckers with the Home Builders Association and builders like Oakwood, but I have a problem with anything that hurts "the little guy".

Anyone an expert on A-34?

who knows who from the Home Builders Association to get that one slipped in.

Still, if a ma and pa company puts up a shoddy house, they deserve to go down. Most builders I know in ma and pa companies take great pride in their work and would be willing to go back and fix any problem. And if that was the case, then no one would have a case against them.

I'd rather ere on the side of protecting homeowners than on the side of a business.

Why don't you just spit your question out my friend? No need to speculate...I'll answer any question.

I don't know as many small time builders as you apparently do, but I do know a ton of small business owners in the Denver metro area. My main concern with this Amendment is what it will do to ALL small business owners. Raise their insurance rates and increase the risk value of small business by insurance carriers.

I've seen many small good - ethical businesses....go out of business because they have been forced to file a claim. The carrier covers the claim then dumps them and they can't get insurance. From anyone. They are forced out of business.

Small business is already being fucked over in this state by the bush* tax cuts and gov BO. It would only take one over zealous homeowner to take down a small builder with this amendment. Why does a homeowner need to sue for treble damages? Who does this benefit? The homeowner or the attorney?

I'm all for protecting the homeowner/consumer, but I'm also against fucking over small business.
