Senate passes bill that restricts eminent domain (still needs House vote)

DOVER -- A proposed law that would make it harder for governments across Delaware to use eminent domain as an economic development tool passed the state Senate on Tuesday

Senate Bill 7, which still has to pass the state House, would be considered a victory for private-property owners and a loss for governments. Gov. Jack Markell will sign it if it passes the House.

Last year, former Gov. Ruth Ann Minner vetoed similar legislation when it hit her desk.

"The governor has been very clear: He'll sign this bill in its current form," Markell spokesman Joe Rogalsky said. "But if somehow there's a way to compromise and make everyone happy, that's what he wants to see."

But requests from Lt. Gov. Matt Denn and business leaders that the Senate take more time to debate the bill were ignored, and S.B. 7 passed 19-0, with Sen. Harris McDowell, D-Wilmington North, abstaining and Sen. Margaret Rose Henry, D-Wilmington, absent
