Del. would have to fight to stop BP plan

WASHINGTON -- A bill that would strip Delaware and other states of the power to block new liquefied natural gas terminals faces a potentially contentious debate on the Senate floor in June.

The Senate Energy and Natural Resources Committee Thursday gave final approval to the Energy Policy Act of 2005, a sweeping bill that touches on everything from modernizing the nation's power grid to increasing federal funding for alternative energy sources like wind power and hydrogen fuel.

The bill also would give federal regulators sole authority to site liquefied natural gas terminals, even if states or local communities object.

The legislation could give the Federal Energy Regulatory Commission the final say on BP's petition to build an LNG terminal on the Delaware River despite the fact that Delaware's Coastal Zone Act prohibits such construction. But federal regulators insist that state environmental concerns still would be able to block new construction if the legislation passes.
