This was a really personal issue and fight for me and I wish it wasn't April Fool's Day when this was published but the actual ruling was yesterday so, again...

The U.S. Supreme Court tidied up part of a messy, centuries-old Delaware River border squabble Monday with a ruling that gave Delaware a clear veto over energy giant BP's proposed liquefied natural gas pier opposite Claymont.

Opponents of BP's plan hailed the decision as a clear victory for Delaware and its Coastal Zone Act conservation law, while one New Jersey lawmaker warned that it could further sour cross-border relations.

BP's state-endorsed Crown Landing LNG terminal in New Jersey would have been served by a 2,000-foot delivery pier built mostly on top of Delaware's part of the riverbed -- an area Delaware considers off-limits to bulk product delivery structures.

Justice Ruth Bader Ginsburg, writing for a 6-2 majority, branded New Jersey's arguments in authorizing the pier over Delaware's objections "implausible," and said the two states share authority to regulate construction on the river in areas where the full width of the waterway lies inside Delaware.

I was not optimistic about this one. I figured they would follow a navigable waterway... FERC... federal pre-emption line and get at least 5.


Reaction to DNREC’s decision boiled over on both sides. New Jersey threatened to withdraw state pensionfunds from Delaware banks, and Delaware considered authorizing the National Guard to protect its border fromencroachment. See Report 21. One New Jersey legislator looked into recommissioning the museum-piece battleship U. S. S. New Jersey, in the event that the vessel might be needed to repel an armed invasion by Delaware.


We would have kicked New Jersey's ass.

With an artillery bombardment of Fort Mott from Ft. DuPont and Ft. Delaware, we could do an amphibious landing using the Cape May Ferry boats, take Fort Mott, and hold everything south of the Atlantic City Expressway. If we took Atlantic City, they wouldn't even have enough quarters to get down any of the parkways for re-supply.

Then we raise the toll on the Delaware Memorial Bridge and cut the Joizy bastards off completely.
