Did election commission break the law?

A state panel wants to know if the DuPage County Election Commission’s housecleaning efforts violated Illinois law.

But the Illinois Local Records Commission stopped short of demanding an investigation when it notified authorities the election commission might have disposed of poll tapes and voter registration cards in violation of the Local Records Act.

“We have no enforcement authority,” said David Joens, director of the Illinois State Archives. “So all we are doing is sending on the allegations to the (DuPage County) state’s attorney and the (Illinois) attorney general’s office.”

In 1985, DuPage’s election authority submitted a retention schedule that inventoried all of the documents in its possession. But in the 21 years since, the commission has never sought permission to dispose of any records.

“If you are destroying documents, you have to get permission from us,” Joens said.
