Hey Iowa.. these young people need your support
This weekend Minnesota Gov Pawlenty said we should take a 9-iron golf club and Smash the windows of Big Government. (and don't even get me started on treasonous Rep Bachman)
And * Iowa Rep. Steve King noted that although the attack (plane flying into IRS building) was “sad,” “by the same token,” it was justified because once the the right succeeds at abolishing the IRS, “it’s going to be a happy day for America.” I think if we’d abolished the IRS back when I first advocated it, he wouldn’t have a target for his airplane. And I’m still for abolishing the IRS.
** YET * In IOWA, Under the ANIMAL ENTERPRISE TERRORISM ACT (AETA) Minnesotans Carrie Feldman, age 20, and Scott DeMuth age 22, activists from Minneapolis, MN, were subpoenaed to a federal grand jury in Iowa investigating animal rights vandalism from 2004.
(that means Carrie was 15 and Scott was 17 at the time)
They both refused to cooperate with the grand jury, and were put in jail. Carrie is still being held on civil contempt of court since 11/09. On 11/19, Scott’s civil contempt was dropped and he was indicted for conspiracy under the Animal Enterprise Terrorism Act.
Scott was released on 11/30 pending trial.
I received an update yesterday:
http://twincities.indymedia.org/2010/feb/scott-demuth%E...Tuesday] morning, over a dozen supporters from Minneapolis and the Quad Cities joined Scott DeMuth, indicted for conspiracy under the Animal Enterprise Terrorism Act (AETA), in the Federal Courthouse in Davenport for his arraignment for the new indictment that was issued last week. There was also a hearing on numerous discovery-related motions for his upcoming trial. Scott’s attorney, Michael Deutsch, argued that the prosecution has failed to produce the discovery that the defense is entitled to under the rules. Judge Shields took the arguments under advisement and is expected to issue a ruling within the next few days.
In the past, Scott’s defense team filed a motion to dismiss the original indictment, arguing that it failed to meet the basic requirements for an indictment. The indictment gave no indication as to what the prosecution alleges Scott actually did, and provided an overly vague time frame for the alleged crime. In an apparent affirmation of this defense argument, US Attorney Cliff Cronk filed a superseding indictment last week.
The new indictment, however, appears to be fatally flawed in itself—it still fails to provide any indication as to what Scott is alleged to have done to conspire under the AETA.
Responding to defense motions, Cronk backpedaled on an earlier strategy to prosecute Scott for his constitutionally protected free speech and associations: “This case has nothing to do with political association … this conspiracy continues as long as alf continues to break into labs and free animals across the country,” Cronk said in open court.
Seeing that the statute of limitations has expired for the Spence Lab break-in specifically, the prosecution appears to now justify Scott’s charges by arguing that the scope of the crime in question extends to a conspiracy involving a furry alien who likes to eat cats and was the star of a TV sitcom in the late 1980s. (Alternately, Cronk may have meant the Animal Liberation Front, which is often referred to by the acronym “ALF”).
Meanwhile, Carrie Feldman is still being held in segregation in Dubuque County Jail and is in need of support. She has been in custody since November 17, 2009 on civil contempt for refusing to testify before a grand jury in Davenport. We are still awaiting the pending re-hearing of her appeal of motions for her release, in which her attorneys argue that the use of secret evidence by the prosecution—evidence to which her defense team was denied all access—violates her due process rights. Here is what Corporate Newspaper Star Tribune reported on MOnday

http://www.startribune.com/local/84922017.html?elr=KArk...Having sat three months now in an Iowa jail, Carrie Feldman of Minneapolis is a hero to scores of animal-rights defenders around the world.
But to the U.S. government, the 20-year-old left-wing political activist is a potential witness who may know something about a daring break-in more than five years ago at a University of Iowa laboratory.
When she refused to testify before a grand jury, a judge ordered her jailed Nov. 17 for contempt of court. She's been in a cell ever since and could legally be held 11 months if she continues her silence.
Her attorney and supporters say Feldman's plight illustrates how the U.S. government runs roughshod over citizens who resist policies they believe unjust. But officials of that government have said she may have ties to domestic terrorist groups and has a duty to tell what she knows.
** In a recent interview, Feldman said she was 15 at the time of the break-in, didn't **** participate in it and doesn't know who did.
The Nov. 14, 2004, attack on Spence Laboratories drew widespread attention when members of the Animal Liberation Front (ALF) released video of themselves breaking into the lab, rescuing hundreds of rats and mice, smashing computers and dumping chemicals. Damages totaled $450,000.
For five years, police made no arrests. Then, in November 2009, they arrested Feldman and her former boyfriend, Scott DeMuth, 22, for refusing to testify to the grand jury despite offers of immunity. Shortly thereafter, the grand jury indicted DeMuth in the break-in. He says he's innocent.
.... the article goes on...
As Republicans continue to make real terroristic comments and advocate for violence.
