A Dubuque County judge has dismissed a lawsuit claiming bias against the Republican Party in the nominating process for the now-filled associate judge position in Dubuque County.
Delaware County Attorney John Bernau, a registered Republican, filed a writ of certiorari claiming that two of the three nominees selected for the final cut by the Dubuque County Magistrate Nominating Commission were "substantially less qualified" than he is and that the commission made the decisions based on political affiliation.
The five 1A district judges of Dubuque County appointed Assistant Dubuque County Attorney Robert Richter to fill the position on July 29.
District Court Judge Todd Geer threw out the suit.
Geer's response states that all three nominees -- Dubuque County Attorney Ralph Potter, Dubuque attorney Steve Drahozal and Richter -- were qualified for the selection, noting that the selection process is more than just comparing resumes. He said the process looks at academic and life experiences and professional experience. He added that the interviews allowed the commission to assess composure, demeanor, temperament and communication skills.
