Thank you for contacting me regarding the Supreme Court.
I appreciate hearing from you.
The selection of a Supreme Court justice is a choice that
affects the inalienable rights of all Americans to liberty, equality,
justice and privacy. We need justices who uphold and embody
these values in their life and work. I recently wrote to President
Bush to ask that he follow the precedent of consulting with the
minority party so that we may arrive at a consensus Supreme Court
nominee. The choice should be one that brings all Americans
together, rather than dividing us as a nation.
Speculation concerning the possible retirement of Chief
Justice Rehnquist has also raised concerns regarding the post of
Chief Justice. The Constitution requires the Senate to confirm a
new Chief Justice of the United States even if that person is
already a sitting justice.
In this connection, I have recently raised concerns
regarding the possible elevation of Justice Thomas or Justice
Scalia to the position of Chief Justice. Among those concerns
include Justice Thomas' disturbing willingness to overturn long-
settled law in pursuit of an ideological end, and the ethical lapses
that have punctuated Justice Scalia's tenure on the bench. Should
either justice be recommended for elevation to chief, these and
many other issues concerning their service on the Supreme Court,
will be thoroughly considered in the Senate.
Please be assured that I will thoroughly review any
decision regarding the Supreme Court with the fundamental values
of liberty, equality, justice and privacy in mind, consult with my
constituents, and exercise my independent judgment as required by
the Constitution.
