(i guess 5% were spoiled?) any way, as conservative as Charlotte feels to me I was stunned that Bowles won.

And the Mecklinburg commissinioners race is fubarred, there were way more votes than voters and that reversed the results the next day after the repukes saw they error and pointed it out (maybe they went home that night and hacked the machines).

I REALLY beleive NC should have been blue as well.

On Monday morn. go to your local BOElections office and get a paper copy of your county's election results.

Get mentally ready to file an FOIA request at that same office, a request that Bev Harris has typed up, and one that I will repost here later today.

I have not been able to access the NC administrative code. Can you help with that? There is a section having to do with election laws. Go to a NC state website and find this administrative code:

DRE and Lever Recounts 08 NCAC 09.0108 This means Chapter 8 of the NC Administrative Code, Section 09 and has to do with the code pertaining to the Direct Recording Electronic and Lever machines used in NC.

Also, I need all my numbers and figures double checked.

Any listings of registered voters form your county and from any county in NC would be helpful. The NC BOE website is devoid of those figures, so it may have to come from each individual county office.

08 ncac 09 .0108 DIRECT RECORD ELECTRONIC AND LEVER (DIRECT RECORD MECHANICAL) VOTING MACHINES

(a) In the first recount, all votes cast on each unit shall be retabulated and results provided. The results provided shall be re-read using the team of four rules outlined in Section I of these Rules.

(b) When the first recount has been completed, the board of elections shall follow these steps:

(1) The county board must determine whether the first recount produces a change in the winner;

(2) If the apparent winner after the initial balloting is the apparent loser after the first recount, that candidate shall be entitled to demand a second recount;

(3) If the apparent winner after the initial balloting remains the apparent winner after the first recount, Subparagraph (b)(4) of this Rule must be considered;

(4) The county board must determine whether there is a discrepancy in the machine totals between the initial balloting and the first recount;

(5) If the unit totals from the initial balloting and the first recount are the same, no second recount is necessary;

(6) If the unit totals from the initial balloting and the first recount are not the same, Subparagraph (b)(7) of this Rule must be considered;

(7) The county board must determine whether the discrepancy in the machine total can be reconciled;

(8) The county board shall determine if the discrepancy in the unit totals between the initial balloting and the first recount can be explained. (Possible acceptable explanations may include problems with the setup of the ballot, problems with the software or other unit malfunction); and

(9) If the reconciliation produces a different unit total for the first recount than the unit total in the initial balloting, the losing candidate is entitled to demand a second recount provided by the county board of elections.

(c) A manual recount, by hand and eye, of ballots is not possible whenever a lever machine or direct record electronic voting machine error occurs.

(d) The State Board of Elections shall hear any appeals of recount protests.

What I foresee is the mess from all that is gonna open some eyes to how bad these DRE's are. Specifically the software used and the fact that the software is a secret.

Friday's Charlotte Observer, 1 the front page header and 2 within.

Said the reason the commissioner's race was messed up (4000 more votes than voters) was because the results from early voting were downloaded onto a central computer, and someone may have downloaded some results TWICE. From reading this I don't know why it should not be clear to anyone that they can do ANYTHING they want with these machines.

A systems software glitch in Craven County's electronic voting equipment is being blamed for a vote miscount that, when corrected, changed the outcome of at least one race in Tuesday's election.

Then, in the rush to make right the miscalculation that swelled the number of votes for president here by 11,283 more votes than the total number cast, a human mistake further delayed accurate totals for the 40,534 who voted.

The glitch occurred Tuesday night as absentee ballot totals for one-stop early voting at three Craven County locations and ballots mailed-in were being entered, said Tiffiney Miller, Craven County Board of Elections director.

The Elections Systems and Software equipment had downloaded voting information from nine of the county's 26 precincts and as the absentee ballots were added, the precinct totals were added a second time. Precincts affected were Havelock East, Havelock West, River Bend, Cove City, Ernul, Fort Totten, Grover C. Fields, Glenburnie and West New Bern.


If anyone is in New Bern, they need to get to the Election office Monday morning and see just what the heck is going on there.

31. One million NC Absentee votes match exit polls!

I just posted this to the regular forum, but this is where BeFree directed me to look at the NC numbers, so I think it is worth posting here as well.

Okay, I've spent the better part of the night with the NC voter numbers, and I've reached the conclusion that there is a stunning case for tampering. Let's start with one sample county. I pulled their election data that lists number of registered voters by county and breaks it down into party affiliation, race, and gender. I chose a predominately black county to give a sharper idea and get free of the crossover voter charge. Here are the demographics for Bertie County, North carolina as of 10-31-2004.

On the face, it's shocking to see a 22% drop in the Democratic vote and a 28% gain in the Republican vote of registered voters. But, we have to be careful in the rural South even in a county that is mostly black. As a reference, let's also look at how the county voted in 2000.

Hmmmm. Well, that shows a 7% swing from 2000 to 2004 for Bush/Cheney. A little hard to believe, but not totally impossible I guess given the possibility that this might be an overwhelmingly democratic black county filled with big Rush Limbaugh fans. Let's look at some further numbers from Bertie and see if they can shed some light.

Notice the Senate race also appears supressed for the Democrats. All other races in Bertie County ran roughly in the range of 73-78% Democrat to 22-27% Republican except for President and Senator. Recall that it was also vitally important for Bush to enter his second term with a substantive majority in the Senate. The same Republican Senate bulge can also be seen in Kentucky for Bunning and likely other states as well. My guess is that they got greedy in states with potential Senate seats and gave them an additional bump to help their majority -- probably making those results even further divergent from the exit polls. It also mirrors the previous data I posted on amendment vote correlation to presidential votes. The bigger the swing necessary, the larger the disparity with amendment votes. (See below for more.)

Now after many hours of going over these figures, I began to ask myself a few questions. If I were to set out to rig the election, how would I go about it? I would have to be smart. There couldn't be a paper trail for them to catch me. The fewer people in on the fix, the better - a programmer or two perhaps but anyone more could create too many loose ends that couldn't be controlled. It would have to be either in the touchscreen machine programming, an entry point in the tabulating computer, or in the main computer's software. Nothing with a paper trail. As we've seen systems with a paper trail came very close to matching the exit polls. Systems without paper trails were often well off the exit polls. BUT THERE'S ANOTHER PAPER TRAIL: ABSENTEE BALLOTS.

With that in mind, I decided to have a look at North Carolina's absentee ballots. It was hidden in the precinct data, so it took me a while to download it and go through it county by county. Incidentally, Lee and Catawba counties reported no absentees, so I don't know if they are missing or recorded elsewhere. But for the other 100 counties, the results are:

Interestingly, that's amazingly close to the exit polls, a 6% difference bewtween Bush and Kerry. The official statewide results, however, show a full 12% difference:

And worst, if one subtracts the absentees, to see how the "vote" actually occurred at the polls, we see a 16% difference -- even further away from the reality of the exit polls -- and this is what they actually sampled!

Holy crap, Batman! The absentees are loudly pointing out the tampering, and I have a strong suspicion that they will prove similar in other states. Absentees are the largest real sample we have (more than a million in NC). Why else would they be SO FAR FROM THE POLL VOTE? THERE IS CONCERTED AND DIRECTED ELECTION TAMPERING!!! CHECK THE ABSENTEES and see how close they come to the exit polls in the states that are out of whack.

One final note...

The other benchmark I used previously was the amendment vote disparity: what percentage of voters voted on both the presidential election and on the state's amendments? Tellingly, North Carolina like Kentucky with a close and necessary Senate race had a horrible percentage. It leads me to believe that whatever fix they were using dropped off the amendment votes (i.e. if it didn't have an R or a D, it didn't register on the change). Just 86% of North Carolina voters seemed to have voted on their top amendment. Using Oregon's paper ballot standard of amendment-presidential vote correlation, it reveals a potential 439,066 missing amendment votes in NC. Dividing that number by the total votes cast gives a percentage of 13%. The figure must be considered a very rough estimate due to uncertainty, but again it is revealingly very close to the exit poll differential.

It is to be expected that there will be changes in number of votes cast for parties and candidates year to year. The fact that one candidate ran better in 2004 than he did in 2000 is not a basis for investigation. There are some counties where the democratic candidate ran better in 2004 than in 2000 and vice versa.


Direct record electronic (DRE) voting systems have been used in North Carolina since 1988 when Guilford County begin to use them. Currently, 40 counties use DRE voting systems. The history of DRE use in North Carolina has been good, with millions of votes cast upon the machines.



All but the very oldest DRE machines are capable of producing a paper read out of their votes and vote totals. These audits are produced at the close of voting for crosschecking poll book data and to keep as records of the vote. As far as producing an individual paper receipt for each voter, there is no widely available DRE on the market now that offers that feature. Sequoia voting systems are planning to test a device that prints such individual receipts for each voter in the September 2004 Nevada Primary, by running those systems in Clark County (Las Vegas). There is much national interest to see how this election goes. Previous efforts to use individual paper receipts for voters did not do well in Sacramento County California, Wilton, Connecticut and a test during a Brazilian election.



Like most other states, North Carolina is awaiting the federal Election Assistance Commission guidelines as to voting systems to make any major changes in our voting systems requirements. These guidelines will not be set prior to the November 2004 election. For 2004, we hope to continue the good record of election administration in North Carolina with the same systems, rules, and procedures we have used in the past. But please be assured that this office is very much aware of the debate over DRE machines, and will continue to monitor it and other voting systems developments as we prepare in 2005 to address the issue.



The recent comments of the EAC chair DeForest Soaries might be of interest to you. He said the commission is hoping to have new standards ready for public discussion by next summer.

"I'd rather move slower and be inclusive and transparent than to move quickly ... with a product that has precision but is perceived to have been done behind closed doors," Soaries said.

"The country owes you a debt of thanks to have taken this challenge of voting systems seriously," DeForest B. Soaries Jr., chairman of the newly formed federal Election Assistance Commission, said to members of the Institute of Electrical and Electronics Engineers, or IEEE, who are in the process of drafting new standards for electronic voting systems.

In addition to establishing new standards, the commission will have to create a process for upgrading the standards as technologies evolve. Commissioners also will look at the viability of putting in place national standards for election procedures. This could include protocol for handling machines that malfunction during an election and physically securing machines and voting data. Soaries said it would likely take three to five years to produce the first generation of such standards.

"This is not a sprint, this is a long-distance race," Soaries said.

The current returns are unofficial and will be made on official on county canvass day, tomorrow Tuesday, November 9th. Those official totals would have been checked several times before tomorrow. After this office receives the county totals, we will audit them as well. The state totals will be made official on November 23rd, the state board canvass day. Incorrect addition, transposed numbers and other errors are caught during these times. We will be looking over each county's total after their canvass.

There was a malfunction of a voting machine in Carteret County because the company technician failed to set the machine to handle a higher number of votes. It was a simple matter of pressing an additional switch. The other counties you refer to were counties that reported total incorrectly and later corrected the reporting, had a ballot error as to the placement of a candidate that was corrected prior to the election, or miscounted the first attempt absentee votes. All those matters were quickly corrected.

The counties you mentioned use a variety of voting systems, punch cards, optical scan paper ballot, and electronic machines that are used by 93 out of 100 NC counties. The seven remaining counties either use paper ballots that are deposited in a ballot box and must be hand counted or lever machines an obsolete technology that has not been manufactured in this country for decades. The point is, that voting systems and the reports of voting totals work as well as the persons who are manning the machines or producing the report. As with every election, human errors do occur, and we have and will continue to address each error as to causation, and whether procedures should change to help prevent future errors. As the high rate of highway accidents show, the human factor in technology is and will be the primary source of accidents and errors.

No state or county board anywhere in our country can guarantee you an election without human error, but we are committed to that goal. Please be assured that the human errors in the counties you name are corrected and actions taken as to them.

35. NC's Absentees are nearly a third of the total votes: it's solid

Just be certain they don't pull the old but-absentees-aren't-accurate-of-the-poll-results schtick. The sample in NC was huge. Nearly 1/3 of the total votes cast in the state! And they did show the usual tilt in favor of white, wealthier voters -- the absentees were 2% more towards Bush than the exit polls. That just makes the case that the exit polls were accurate all the more solid.

40. Bowles Won The Absentee Vote: A Look Inside the Numbers

Okay, first up I looked at the absentee voting for the NC Senate between Burr (R) and Bowles (D). I'm happy to announce after another night of pouring through this stuff that Bowles won the absentee voting by a very slim margin.

As stated, absentee votes have been discounted as a predictor in the past because they favored a more white, suburban, conservative base out of proportion to the overall vote. With that in mind, let's subtract the absentees from the overall election to find the actual poll vote. We find oddly, just the opposite by a whopping 6.8% gain for the conservative candidate Burr. By moving against the grain, it only makes the case more solid that the absentees are giving us clear evidence of tampering with the poll numbers.

It is absolutely absurd that anyone can believe the poll results could be so far out of balance. It isn't in the realm of reality. Further, absentee ballots accounted for nearly 1/3 of the overall vote (29%) at just over a million votes. The possibility of an anomaly becomes more insignificant as we approach a greater percentage of the overall vote. There is no doubt in my mind that this thing was rigged, but look at the data and draw your own conclusions.

With the senatorial data we have another set of parameters beyond the presidential returns with which to work. It allows a little better look inside the numbers. Let's see if we can glean anything about how much of a boost there was in the poll vote.

I'm going to begin with the pretty solid assumption that absentee votes tend to be cast by a higher percentage of white, suburban voters than the overall vote. Therefore, if the opposite pattern appears then something is really skewing the data. The differential in NC's presidential percentages is 9.4% toward the conservative candidate Bush. The number is screaming that something is very, very wrong in the poll data. 9.4% is arrived at by looking at the absentee data where Bush led Kerry by 6% (52.9% to 46.9%) and at the poll data where Bush led Kerry by 15.4% (57.5% to 42.1%). Subtracting 6 from 15.4, we get 9.4. It appears that Bush got a bump of 9.4 against the normal grain of elections.

To refine the data further, let's look at the Senate race. The absentee vote was practically tied with a very small margin in favor of Bowles -- the differential is 0%. The poll vote again went against the grain and gave the Republican Burr a 6.8% advantage (52.6% to 45.8%). 6.8 +/- 0 = 6.8. Now, let's take the mean of 6.8 and 9.4, and we get 8.1%. So based on my assumptions, I'm going to say there conservatively appears to be an 8% push of numbers. I would be happy if a statistician could provide more insight, refinement, or adjustment. My work isn't meant to be conclusive, but a starting point.

What would an 8% differential mean to the results? The 56-44 (12%) presidential win for Bush, would have been reduced by 8 to 52-48 (4%), identical to the exit polling. And Bowles would have switched places with Burr, defeating him 51-47.

I have to wonder how this mix up has happened.

I have the county numbers, precinct by precinct for NC. The absentee totals are very high. Are the early voting totals lumped in with the absentee totals? If not, then there was an enormous absentee effort, with fewer people showing up at several precincts on election day. I'm guessing it has to include early voting.

If this is the case, is there any way to really know who voted from each precinct?

I'll be glad to share my numbers with anybody interested.

46. NC Absentee Vote Correlates: A Case For Tampering

One area I reviewed as a possible signature of fraud was a ratio of amendment vote to presidential vote. Two avenues of tampering that I can think of would leave a trace if the ratio was substantially different for different voting systems. An undervote in amendment counts would indicate a hacker simply adding a number of votes for the candidate of choice, or a code flaw that switched (R) and (D) votes for instance but dropped those that didn't meet the party criteria like amendment counts. In NC, however, the amendment-presidential vote ratio is nearly identical in absentee and poll votes at around 86%. What do we draw from that?

I think it is safe to rule out simple vote adding by a hacker unless they were sophisticated enough to add votes in all categories -- not likely. (Of course, a hacker could still simply swap votes without throwing off the ratio.) For those states that suspect simple accounting adds as a source of fraud, I would say check the overall vote count from the polls and the absentee ballots and measure the ratio of presidential to amendment votes in each. If they're distinctly off, you may have someone or a tabulator doing candidate specific adds. If they're not off, you probably need to look elsewhere. Vote adds are simply too easy to spot as we have seen nationally in a few counties. My take is that those adds are likely to be just errors, not the real source of fraud. If we're dealing with this concerted of an effort, the people involved are going to be too smart for that (caveat: unless they panicked late in the game in a close state like Ohio that was needed to swing the election).

In states like North Carolina where the exit polls are far off the results, however, ruling out the amendment differential strengthens the case that the poll voting disparity was achieved by hidden programming either at the touchscreen level or in the central computer. It could be a vote flip of some kind or a tabulating percentage. Additionally, the percentages voting for and against Amendment 2, the amendment I first checked, are nearly identical in the absentee and poll voting -- but wait, isn't that suggestive that the disparity between Presidential and Senatorial votes might have been pushed in the poll data by a programmer? If the absentee vote is in agreement with the poll results on the amendments, it makes a strong case that the other results should also reflect parity. These are the results:

Hey now, that looks like a freaking match. After I saw that, I decided to take a look at the other amendments on the NC ballot. I wanted to really test the parity of the large absentee vote with the poll vote by hopefully finding a divisive amendment with close results. The importance is that a state amendment vote (except for possibly the marriage protection nonsense) does not have any *national significance*, so there is absolutely no reason to rig a state amendment if one were looking to influence national results. Get it? It simply doesn't matter in the national scheme and neither does it have an effect on any party's office totals, majorities, or policy/contract influence. At the same time, however, an amendment can be considered along the same lines of conservative (anti-tax) and liberal (public works/spending). If such an amendment presented itself, it could serve as a damn good benchmark for the correlation of the absentee and poll votes. If the absentee votes were weighted by a large influx of urban liberal voters, let's say, it would show up by forcing a clear disparity with the poll vote. If no disparity shows up between the absentee and poll results, then it makes an extremely tight case that the absentee vote is in sync with the poll vote.

Enter Amendment 1. NC Amendment 1 was asking for approval of a revenue bill that would provide funds for community development projects by increasing property values and therefore property taxes. Perhaps some North Carolinians can comment further on the meaning and specifics, but looking at the county demographics, counties with higher white Republican bases appear to have been more opposed to the measure. Heavily Democratic bases tended to favor it. The vote, like the Senate race, was very close with a slim majority in favor of it.

The results are in lock-step! Now, how in God's name can the Presidential and Senatorial poll results be so divergent from the absentee ballots in NC -- nearly 15.4% on the Presidential side and nearly 7% in the Senate race -- unless there was election tampering? With the amendment parity, it cannot be argued that absentees which account for nearly 1/3 of all NC ballots (one million+) were out of balance due to a new influx of voters, demographic distribution, or otherwise. They are absolutely in sync and someone has obviously rigged the polls from where I see it.

Also, looking at the magnification of the Presidential vote, over 15% compared to the roughly 7% in the Senatorial vote, my guess is that it may be indicating a "vote flip" rather than a straight percentage gain. The larger the initial spread, the more it will be magnified in the results -- possibly explaining the Bush 15% lead over Kerry at the polls whereas Burr's gain over Bowles was 7%.

right? i think it must with the numbers being so high. also, if you look at precinct by precint results and compare to 4 years ago, you will find many precinct totals on election day dropping from four years ago.

i can only conclude that the absentee ballots this year includes early voting. as we know, early voting totals were cast in record numbers. remember how we all encouraged the dems to vote early...which they did.

we need to find out who voted early...dems v reps. if we have more early voters that may have voted kerry/bowles, then perhaps these totals are skewed overall toward the democrats.

i'd also like to get a precinct by precinct breakdown of the early voters in NC to see where strange precinct results actually exist. rigth now, it is impossible because this early voting total is simply lumped in with the final absentee vote in each county.

No, the point of the amendment correlation is to show that the absentee vote is not skewed. They are in lock-step with the overall results. There is no party swing. They record about 1/3 of the total vote and are directly in balance with the poll vote outside of President and Senator.

Therefore, if the absentee count involves early voting, it means that fix was put into place on or just before election day -- most likely at the central computer.

When I saw the BOE print out from my county on Nov. 3rd, the absentee/early voters were in the same column. The a/e vote was 60/40 Kerry. But the totals were 52/48 bush. That raised my, and several others, suspicions. Even some old time hacks here said the numbers were "crazy."

One explanation I got was that the Dems had gotten out the early vote and that is what skewed it. Don't believe it but as of yet I can't come up with a real good rejoinder. The amendment example may be it but I just don't quite get how.

I think they are telling us something extremely serious about what happened in NC and nationally on election day. If there is a conclusive study here that shows the numbers were rigged, it will have national implications because it is indicative of an inside effort. What would you say if all other NC races in absentee voting were spot on the poll results? That is, the one third of the electorate who voted early/absentee mirrored the final results in the other partisan races, proving conclusively that the early/absentee vote was not more heavily Democratic -- and yet two races and two races only were exceptions at the polls. After looking over your pages, it seems something funny occured.

The shift to reps on final day in favor of pubs certainly seemed a bit whacked, eh? Yeah, a few dems moved up on final day, but in all the statewide races that showed movement, pubs were the lucky ones.

Thanks for posting the site, very clean and comprehensive. Was that coded by hand or was a program used?

The Bush campaign got into as many churches as possible (you know, the ones that hate taxes and gays but love guns and money). They spent all afternoon on GOTV, calling their bigoted grandparents, narrow-minded aunts and gun-nut uncles, and turned the tide late in the day.

Sounds plausible, right? Which is precisely why Rove put it together. It threw us off the scent.
