There is no evidence that the State Board of Elections made any effort to prevent Diebold from getting permission from a republican
judge to skirt the law! None. As if they wanted it to happen, is how it seems. To not act is to act, sometimes.
Influential Democrats in Mecklenburg County don't like or want
Voter Verified Paper Ballots. But they don't seem to mind Diebold
tromping on NC law!
BOB CORDLE IS ON THE STATE BOARD OF ELECTIONS, AND
HE VIGOROUSLY OPPOSED THE VOTER VERIFIED PAPER BALLOT. He is a
Mecklenburg County resident, as is Roger Knight, another democrat
from Mecklenburg who sometimes serves as legal counsel for the SBOE. Knight also vigorously opposed VVPB.
If Diebold gets their foot in this state, it will be because a judge
told them that the law, S223 does NOT apply to them, and because the
State Board of Elections DID NOTHING to defent the law.
STATE BOARD OF ELECTIONS DOES NOTHING WHILE DIEBOLD ATTEMPTS TO
EVADE LAW, VOTING ADVOCATES HAVE TO GO TO COURT TO DEFEND!
Diebold Attempts to Evade Election Transparency Laws
The Electronic Frontier Foundation (EFF) is going to court in North
Carolina to prevent Diebold Election Systems, Inc. from evading North
Carolina law. In a last-minute filing, e-voting equipment maker
Diebold asked a North Carolina court to exempt it from tough new
election requirements designed to ensure transparency in the state's
elections. Diebold obtained an extraordinarily broad order, allowing
it to avoid placing its source code in escrow with the state and
identifying programmers who contributed to the code.

N.C. Elections Board Sends GOP Fine Ruling Back To Judge

RALEIGH, N.C. -- The state Board of Elections criticized a judge's
recommendation to throw out a nearly $200,000 fine against a national
Republican group, saying on Friday that he overstepped his authority
in making the decision....
In a 3-2 decision, with Democrats in the majority, the board sent the
case back to Morrison and told him it wasn't his job to examine the
merits of whether the ad was lawful, but only to consider whether the
civil penalty was proper.
The state Democratic Party is pleased with the decision, executive
director Caroline Valand said in a statement.
