"I'm concerned that provisional ballots be counted the same way in all counties," he said. "And my experience in provisional ballot counting is that all counties count ballots differently."
Hunter included a list of provisional voters in each county whose ballots he said should not be counted in the Hayes race. In Mecklenburg, that amounted to 122 of 195 ballots, according to Elections Director Michael Dickerson.
Hunter said he wasn't sure how many provisional voters he challenged, but called it "a large percentage."
Kissell accused his opponent of trying to "suppress" votes.
"Mr. Hayes is running his legal challenge against voters like he ran his campaign -- scared, desperate and loose with the truth," he said in a statement. "I'm more determined now than ever to fight for every voter in our district to be heard."
