Candidate gets OK to replace Ney

Big surprise ... Ken Blackwell okays the Republican candidate to do the same thing that the law was passed to keep a Democrat from doing ...

Ohio's so-called ``sore loser'' law generally prevents candidates defeated in a primary from running for office in the fall as an independent or write-in. Padgett ran for lieutenant governor this spring with Petro, who lost the GOP nomination for governor to Blackwell.

Padgett's status in the May primary was not covered by the law, and she is free to seek Ney's seat, Petro said. Democrats probably will take the case to court.

Ohio law generally prevents candidates defeated in a primary from running for office in the fall as an independent or write-in. Padgett ran for lieutenant governor on a ticket this spring with Petro, who lost to Blackwell in the race for the GOP nomination for governor.

However, Petro said Padgett's status in the May primary was not covered by the state's "sore loser" law and she is free to seek Ney's seat.

The (Democratic) party believes the "sore loser" law applies and Padgett also falls under a provision that says one cannot run for federal and state offices in the same election. That provision was put in the law by the GOP-run Legislature to keep Ted Strickland, the Democratic candidate for governor, from running simultaneously for that office and another term in Congress, something Strickland said he never considered.

The law says a person who loses a primary cannot seek office in the general election if that person got on the primary ballot through nominating petition or by a declaration of intent to become a write-in.

Padgett got on the May ballot by "declaration of candidacy," a term not covered under the law, Petro said.

On the one hand, I want there to be a primary and force the Wicked Witch of the East to spend $$$ campaigning. On the other hand, I don't want $500k of my tax money pissed away on a special election.:shrug:

7. I think there will be a primary
and that more than one will be running. The GOP has to cover their behinds on the strong possibility that Joy will be eliminated because of the "Strickland law". They have to have a backup candidate ready to step in.

I wish that the primary wouldn't happen because the republicans will have the floor during that time and will be able to build momentum for the fall election.

If life was fair, the GOP would have to pay for the election. (Hey, I can dream, can't I?)

8. Update
The Tuscarawas County Board of Elections is set to decide today how to replace 18th District Congressman Bob Ney on the November ballot. Board member Doug Wills says the law requires a special election after Ney officially withdrew from the race Monday morning. Coshocton State Senator Joy Padgett says she’s ready to run regardless of the board’s decision.

Tusc. Co. BOE makes the decision because it is has the largest population in the district. Socrates Space, a Democratic BOE member, will recuse himself because his son Zack is a candidate. Doug Wills is the GOP party chairman and BOE member. In this case, the GOP will get what it wants. I believe there will be a primary.

9. Special primary in Ney's district set for Sept. 14



The special 18th Congressional District primary to pick a successor to Rep. Bob Ney as Republican nominee will be Sept. 14, says Charles Miller, director of the Tuscarawas County Board of Elections.

Those thinking of running have little time to decide, as nominating petitions are due by 4 p.m. Thursday. The elections board hopes to know who qualifies by the end of Friday, although any protests could delay making it official. You'd think that getting 50 qualifying signatures wouldn't be hard, but, well, remember Charlie Wilson?

Joy Padgett, the state senator favored by a number of party leaders, already has folks out circulating the petitions. She isn't sure about other potential candidates but said, ""There's been a lot of discussion that if I don't get in, there's probably 12" others who will. "There have been a lot of calls to me and calls to others who have said that if I didn't run, they would definitely be interested."

James Brodbelt Harris, another potential candidate (he lost to Ney in a primary earlier this year, before Ney dropped out), says he hasn't decided whether he will run in the new contest.
