Mom gets 10 years in prison
Source: Springfield News-Sun

SPRINGFIELD, Ohio — Michelle Davis, 23, slumped in her chair and bowed her head as she was sentenced Friday, Oct. 31, to the maximum 10 years in prison.

Last week, she was convicted of involuntary manslaughter in the death of Christian Wiseman, her 1-year-old son, in January 2007.

Davis' husband, Chris Grieve, 26, was found guilty of involuntary manslaughter last year.

Grieve, who was caring for the child while Davis was at work Jan. 12, 2007, was accused of throwing the toddler head-first onto the ground.

<snip>

The couple took the child to the hospital the following morning. He died five days later.

2. She wasn't even THERE at the time???
Wow.
That makes little or no sense. I don't buy the idea that she was trying to 'protect her husband and herself'. Trying to protect her husband, maybe, but what did she need protection from? This is bizarre.

5. Getting the facts straight
This is a case that is very near and dear to me.

There are things that the papers left out in regards to this case. First, Christian did not have a mark on his body. Not even a bruise. Had he been thrown into a floor head first one would venture to say that he would quite possibly suffered a bruise of some sort. Chris made several confessions that did not coincide with physical evidence. He stated that he physically dropped Christian on his head. But where were the bruises? Christian lived for 5 days after he was found unresponsive. Per autopsy, he suffered a hemmorage at the frontal lobe. Prosecutors claimed SBS - contrary to the written confession. Michele and Chris were doing drugs on the evening prior to Christian's trip to the emergency room. There are timestamped photos of Michele packing a bowl. She was 4 months pregnant at the time. Subsequently, she lost custody of the baby immediately after birth due to her drug use. Michelle was due in for work at 3 p.m. and Chris came home from work (they worked at the same place) so that he could take over Christian's care. He was alone with Christian for appoximately 35 minutes before a friend came over to hang out. Chris then fed Christian and while he was fussy did not show any signs of any injury. Michelle came home from work at about 11 that evening. They packed the bowl, smoked some pot and Christian woke up groggy with a high pitched cry. The friend stated that it seemed to them to be similar to "night terrors". They gave him a bottle and put him back to bed. The next morning, around 7 a.m., Christian was found in his bed, unresponsive. 4 hours later he was taken to the hospital. No one could explain what happened. There are several theories - Christian had his MMR vaccination the day before which has a slight rish of brain hemmorage, he also spent time at his first birthday party where he reportedly vomitted and was sent home by his biological father (had a history of duct taping this child to a bed as an infant) who couldn't deal with it anymore, he spent the entire day alone with his mother and he was alone with Chris for a short time. Reality is that no one knows what really happened to Christian. Law enforcement was called in and Chris was taken in for questioning. Per video evidence of the interrogation - Chris was told that either he or his pregnant wife was going to jail for this. At that time Chris stated that he would not let Christian die without his mother and that he would take responsibility. He confessed several more times. The newspapers reported that Chris, in a fit of rage, pulled Christian out of his high chair and threw him into the floor for refusing to eat. Then he put him to bed. Is this a normal human response? Usually, they shake the child, not unbuckle them, remove a tray and then throw them into the floor. Either way, Chris confessed. At indictment he plead not guilty. Once trial began, the jury had been selected and one expert testified then court was adjourned for lunch. By the time court reconvened Chris was presented with a plea deal for involuntary manslaughter based on the fact that he did not seek medical attention immediately when Christian was found unresponsive. His attorney advised him to accept the plea deal, which he did. How to you go from Murder charges to Involuntary man in less than an hour of trial? The prosecutor then told the local news reporter that Chris plead to the murder, which was untrue. I personally called the news station and demanded this be corrected.

Michelle stated to family members that she shook Christian before Chris came home from work. She got irritated with him for being whiney, according to her. She stated that Chris was unaware of this and she never told him. In the confession tapes, Chris states to Michele that he threw Christian onto the floor. She corrects him and states that he shook him instead. This is AFTER he signs a confession. Why would she need to do that? It's unfortunate that this information was no available to the public even though reporters were present at trial.

Personally, I felt that it needed further clarification.
