Texas found in violation of Medicaid agreement

More children going without checkups, judge finds
A federal judge has found the state in violation of an agreement meant to improve health-care access for Medicaid- eligible children and young adults.

The ruling, by senior U.S. District Judge William Wayne Justice, comes in a class-action lawsuit by San Antonio attorney Susan Zinn claiming that the state violated federal law by failing to inform poor families of available services.

As a result, the state signed an agreement in 1995 saying it would improve health-care access for indigent youths.


Once again the miserable failure of the republican legislature has been called to task. And once again the repukes (Attny General and alleged leadership) are running to to the 5th U.S. Circuit Court of Appeals, to prevent them from having to do the right thing. Remember that bu$h was governor in 1995 when this order was signed and nothing under either bu$h or perry has changed. They are intent on leaving every child behind.

Oh, but I'm sure Kinky would have a better solution :sarcasm:

1. My kids are both on Medicaid
The "card" that I get every month said that both kids were due for checkups. My eleven year old son was scheduled with no problem. However, the doctor's office told me that Medicaid will not reimburse them for checkups for seven or nine year olds, even though it points out the need on the card. They said as soon as my daughter turns ten, they'll do one.

I do find it very disturbing that your daughter can't get a paid checkup until she's ten. They tell you your daughter needs a check up but they won't pay for it. That's just plain crazy.

Here's another part of the story and why U.S. District Judge William Wayne Justice ruled against Texas:
However, the number of children on Medicaid who received no medical checkups has jumped from about 1 million in 1998 to 1.45 million in 2004.

The number of children "who should have received (medical) services but received none has actually increased since entry of the consent decree (in 1995)," Justice said.
