Charge against Sears dropped
Prosecutors have agreed to drop an illegal campaign contribution charge against Sears, Roebuck and Co. in exchange for the company's cooperation with a state investigation of contributions to a Republican political action committee.

A Travis County judge signed off on the agreement Thursday.

Sears was accused of making a $25,000 donation to Texans for a Republican Majority, a political action committee with ties to U.S. House Majority Leader Tom DeLay, during the 2002 legislative campaign. The use of corporate money for political purposes is illegal in Texas.

Attorney for Colyandro asks judge to dismiss election money indictments based on law's wording.
A Texas Republican indicted on charges that he illegally used corporate money has asked a Travis County judge to dismiss the charges.

John Colyandro, former executive director of the Texans for a Republican Majority, isn't a candidate, an officeholder or a political committee, so he couldn't have accepted illegal corporate contributions, his lawyer argued in court documents filed Tuesday. Texas law states that only those three entities are capable of accepting contributions.

"The legislature has chosen not to criminalize the acts of an individual who is not a candidate or officeholder," lawyer Joseph Turner wrote. "The indictment, therefore, cannot stand."
