Madison - State Supreme Court Justice Michael Gableman filed a motion Monday to dismiss an ethics complaint against him, saying the First Amendment does not allow the court to regulate inferences in political speech.
The state Judicial Commission filed a complaint against Gableman in October that alleged a campaign ad he ran last year violated an ethics rule that says judges can't lie about political opponents. Gableman won that race, defeating then-Justice Louis Butler.
The case is now before a three-judge panel, which will report to the Supreme Court on whether it believes Gableman violated the rule and what punishment, if any, he should face. . . . "
