Waukesha -– Michael Gableman’s attorney argued Wednesday an ethics case against the justice should be dropped on First Amendment grounds and because the claims in a campaign ad at the heart of the case were all true.

The ad charged former Justice Louis Butler “found a loophole” for convicted child molester Rueben Lee Mitchell, who went on to offend again.

Butler, who served as Mitchell’s attorney on appeal, was unsuccessful in his arguments before the state Supreme Court, and Mitchell served his full term. Mitchell -– who Gableman attorney James Bopp referred to as a “scumbag” throughout the hearing -– committed the second offense after his release.

While there were certain facts that were not presented in the ad, Bopp contends that all the statements made were truthful.
