Collective bargaining law published despite court order blocking it

A restraining order had prevented Secretary of State Doug La Follette from publishing the law, the final step in implementing it. But according to the state constitution, laws must be published before they can take effect; it does not specify by whom.

Under state statutes, the secretary of state is required to set a publication date no more than 10 working days after a law is signed. A separate law requires the Reference Bureau to publish legislation within 10 days of enactment.

No action by the secretary of state is required for the Reference Bureau to act, Department of Justice spokesman Bill Cosh said, adding that La Follette did not direct the publication of the law and is not in violation of a temporary court order barring him from publishing the law.

Nevertheless, the governor's office said Friday that the law will take effect on Saturday.

1. Just how twisty are these guys?
These guys are twistier than a broken corkscrew.

But this just makes their case look worse when THIS gets taken to court. The courts don't generally look favorably on being loopholed-around. I imagine even judges that may have been sympathetic to Walker and co. will take this as the slap-in-the-face to the courts that it really was.

On a slightly different note, isn't this just more behavior from the WI GOP that's EXACTLY like the behavior of a 5 year old?

Akin to: "You said to keep my hands to myself...but you didn't say I couldn't kick my sister!"
"You said that the Sec. of State couldn't publish the law...but you didn't say these other guys couldn't!"

3. Killed the bill as is
They will then go right back to repassing it again, and we may see another round of Democratic lawmakers heading outstate again.

6. Maybe they can't pass it again
I read that Scott Fitz let slip on Greta van Sustern's program that they don't have the votes anymore to pass this bill: "Greta, you know that the legislature is always very tentative, and you may have the votes on one day and then you don't on the next." (This is from the tape, not Fox's doctored transcript.)

The blogger also writes: "I've heard from some several high-level sources that recall Senators Kapanke, Cowles and Olsen would change their votes if they re-voted on the measure, while the other recall senators would vote the same way."

The threat of recall apparently affects some but not all. I've wondered why they don't just pass the bill again now that the 14 are back. This is very probably the reason.

4. I am amazed by their lack of respect for the law.
They truly think that laws don't apply to them. I am hoping that the Wisconsin citizens will see throught this latest power-grab and elect Kloppenburg for State Supreme Court. If Prosser is reelected, Wisconsin democracy will be doomed.

5. Contempt of Court
plain and simple...

Wheeler report reprint of the Judges ruling shows that she ENJOINED IMPLEMENTATION of the law....it is complete and unequivocal.

Fitzgerald and Walker need to be found in contempt of court and fined or imprisoned as dictated by law.
