Justice Rears Her Head in Wisconsin As Kathy Nickolaus is Investigated by GAB

In case you were wondering where justice was hiding in Wisconsin, she’s reared her head in Waukesha County. County Clerk Kathy Nickolaus will be investigated by the Government Accountability Board, which certified the Wisconsin Supreme Court election in question.

A former Dane country prosecutor will finally be looking into Nickolaus’ conduct. And by conduct, I mean misconduct, including open ballot bags with no secure chain of custody, voter rolls with tags that don’t match ballot bags, a canvas called a day early which took place with Nickolaus never telling the other canvassers about the “lost” votes for two days during the canvas and much more.

This particular Nickolaus saga started when she announced that she had left the city of Brookfield off of the totals she initially reported, but this is hardly her first brush with being investigated. Nickolaus has a track record of criminal investigations and reprimands from county officials regarding the failure of security in her procedures, which she chose to ignore, preferring to keep all of the voting data on her computer and refusing to upload it per procedure to the county computers. Under this modus operandi, she suddenly discovered votes she had “lost” by forgetting to press “save” and hence, Nickolaus came under scrutiny. Normally in a canvas, those votes could be accounted for in real ballots by the canvassers, but they were not given an opportunity to verify Nickolaus’s found votes as she did not tell them about the error until minutes before they faced a press conference, long after the canvas was completed.

In 2005, Ms. Nickolaus was found to have sent out “sample ballots” to the voters that came premarked for a certain candidate. Ms Nickolaus’ many errors always benefit a Republican, but this should be no surprise as she used to be the computer analyst for the GOP assembly, during which tenure she was granted immunity in a criminal investigation resulting from said work.

The Post Crescent reports:

The complaint against Kathy Nickolaus was filed with the state’s Government Accountability Board by campaign officials for JoAnne Kloppenburg, who lost the April 5 election to Justice David Prosser.

Kloppenburg’s campaign manager said Wednesday that Tim Verhoff informed the campaign that he’d be investigating.

The wheels of justice can be slow and frustrating. It will be even more disturbing if the misconduct of Nickolaus proves to have swung the election results for the incumbent conservative Supreme Justice Prosser, who won after initial results had his challenger Kloppenburg winning. Since then, Prosser was the swing vote reversing Judge Sumi’s void of the bill that killed collective bargaining in Wisconsin and he has been accused of choking a female Supreme Court Justice during those deliberations. The choking incident is currently under investigation.

The good news is that the GAB did not turn their backs on the logs detailing the problems with the Waukesha County process provided by the Kloppenburg campaign.

Madison Wisconsin - Breaking news today in the Prosser/Kloppenburg recount — as it turns out the software that Kathy Nickolaus used the night of the election was written specifically for her. Yes, I am not kidding you. Politiscoop for the last few weeks have been pressing the GAB to explain this. The Fix is on article we published on Sunday, 10 April 2011. Since then we have been asking for answers — we have even emailed the pdf of what we were sent and we have yet to receive an answer from the GAB. Could it be this new revelation played a part in Prosser appearing to have won the election two days before the votes were cast? — We still don’t know and we do not know why there has not been an answer given to us.

Today the website http://www.milwaukeenewsbuzz.com revealed that a through an open records request an email was sent to county clerks around Wisconsin. It stated the following:

The email, by Rusk County Clerk Denise Wetzel and addressed to other county clerks in Wisconsin, including Nickolaus, was sent on April 8, the day after Nickolaus revealed the vote-reporting error in a press conference. It reads, “Please note that the program Kathy uses IS NOT the new canvass reporting program that is in the (Statewide Voter Registration System) that we all have been using as of late. It is a completely different program that was created by GAB for Kathy to accumulate her votes prior to uploading them into the program that the rest of us use.”http://myplayfulself.com/wordpress/archives/5402

Wisconsin GAB Wrote Erroneous Software For Waukesha County Clerk Kathy Nickolaus
Milwaukee News Buzz reports that the computer program that caused Waukesha County Clerk Kathy Nickolaus to erroneously report vote counts for the Wisconsin Supreme Court election was written by the Government Accountability Board. This fact alone puts into question the impartiality of the investigation into Waukesha County's election issues by the GAB. They can't properly investigate their own software.

Not only was the GAB program written poorly, but the GAB has refused to provide details on the computer program. The GAB cannot be expected to impartially investigate Waukesha County and its election systems. The GAB should publicly post the source code for the software, since Wisconsin owns it, but they won't even tell us more than Nickolaus has. It's clear that the GAB should not be in charge of investigating elections, and their refusal to provide further details is particularly concerning.

I'm out of new ideas as to how we can get an impartial investigation. One Wisconsin Now is still collecting names for their petition for a separate bipartisan investigation. However, contacting your government representatives and the press will probably be most effective.

12. Thank you for the informative read
GAB is run amuck but what to do? The NEOCONS control all branches of the government and the Feds are apparently not interested in what Clerk Kathy has been up to. I have a conspiracy streak but what is one to think with all these loose ends and the dots not connecting. It makes me believe the Feds are complicit!

13. Could it be they want to throw her under the bus to take the heat off themselves?
Or in hopes it will take the heat off themselves...Is the GAB a bit worried that we WILL win the recall elections?

5. Is this right?
There is a recall going on next month, in her district, and she will be doing her "job" as usual? For a party so concerned about election fraud (or supposedly concerned) that they have to disenfrachise voters to make sure it does not happen it seems odd that they would be complicit in her shenanigans.

14. Yeah, this article - or this news about the GAB writing and giving
Nickolaus her own special software came out in April or early May as I recall. DU probably has it in the archives

Sample ballots printed for Waukesha County executive special election give voted unintended advice: who to vote for. Published in several newspapers this week (October 14th,2005) sample ballots promoting Tuesday’s contest between James Dwyer and Dan Vrakas include a mark signaling a vote for Dwyer.

The red-faced county clerk Kathy Nickolaus said, the gaffe occurred when her office sent some newspapers the same sample ballots that had been marked to test the voting machines. “It was human error” she said…. The tainted sample ballots are being published in newspapers in Brookfield, Menomonee Falls, Mukwanago and Sussex. Along with both candidates’ names and detailed instruction on how to complete a ballot, there it is — a hand drawn solid line designating a vote for Dwyer.


I wish the voters had taken her advice.
