MADISON, Wis. (AP) - A rural prosecutor will decide whether to charge Wisconsin Supreme Court Justice David Prosser with attacking a liberal colleague.

Sauk County District Attorney Patricia Barrett said Monday she has accepted a request from Dane County's chief judge to serve as a special prosecutor in the case. Now she must weigh Justice Ann Walsh Bradley's accusations that Prosser choked her in June and decide whether to bring criminal charges against a sitting member of Wisconsin's highest court.

Barrett, a Republican, said she's still waiting for Dane County Sheriff's detectives to forward their reports to her and didn't know when she might make a decision.

1. I still can't believe we have a supreme court justice who chokes another justice.

3. It's official: Justice for sale in Wisconsin
"Justice Prosser's commitment is to the oath of office. By no means would any contractual obligation (with a lawyer) cloud that obligation." Brian Nemoir, campaign director for Wisconsin Supreme Court Justice David Prosser.

Some statements are so ridiculous — and utterly abhorrent to the concept of an independent judiciary — that they deserve immediate rejection from anyone looking for a fair hearing when they have their day in court. Prosser, who recently won re-election to the high court after a bruising campaign and divisive recount last spring, raised $272,887 in campaign contributions during the recount period.

He spent more than $75,000 on legal services at the Troupis Law Office, which has a major First Amendment case before the court, according to the Milwaukee Journal Sentinel. The newspaper reports attorney Jim Troupis is representing tea party groups and other conservatives in a case they brought last year to halt state regulations on political speech.
