OSHKOSH, Wis. -- An honor student accused of killing a man did so intentionally and deliberately and later told his friends about it to create an emotional bond with them, a psychologist testified Friday.

Hirte's defense attorneys say Hirte murdered Kopitske because he was in a "unbelievable" rage after Hirte got drunk and the two had sexual contact. Prosecutors call the theory fabricated and say the Eagle Scout, straight-A student and athlete planned the murder. They say he did it to see how it would feel and if he could get away with it, took his keys as a trophy and then bragged to friends about it.

He was found sane which is going to find him guilty.

The fact that this guy is using "homosexual rage" scream desperate because he's guilty to me. And there's a lot of talk that Kopitske wasn't even gay anyways so the guy could be lying about that as well which means he must truly hate gays to use their lifestyle as a murder defense especially if no gay interaction ever occured.

Jury Finds Hirte Not Mentally Ill
Verdict Unanimous After 2-Hour Deliberation

OSHKOSH, Wis. -- A Winnebago County Circuit Court jury in Oshkosh found an Eagle Scout was not mentally ill in the killing of a man during summer of 2003.

After deliberating only about 2 hours, the jury returned its unanimous verdict just after 9 p.m. Friday in the sanity trial of Gary Hirte, 19, of Weyauwega.

4. We all thought that it was a strange story

This case has been discussed at work by several people. Before they came up with the homosexual story, we all thought that Hirte was quite a sociopath, having absolutely no reason to kill the victim except his own vanity. Then he told friends about it like he was proud of it or something.
As far as the homosexual story, we thought that the defense was trying to play upon people's homosexual prejudices. I am glad that it didn't work.

5. Seems the defense came up only after Boyle saw the lab report

which found the victim's semen on his body, but none on the defendent's clothes. Hence, the "story" that there was oral sex which, because it wasn't reciprocated, caused the "homosexual rage" as the Northwestern's headline put it.
