Tories win ‘in-and-out' advertising feud
The Conservatives have won their “in-and-out” court battle with Elections Canada over ad spending during the 2006 federal election campaign.

A Federal Court judge today set aside the chief electoral officer's decision to refuse to certify $1.2-million in challenged expenses.

The judgment is a blow to Elections Canada, which argued that national radio and television advertising should have been claimed as expenses by the party rather than by individual candidates.

I actually don't perceive this as a win for Harper, in the current environment. I think it reinforces the notion that he uses the letter of the law to get around the spirit of the law.

for the Cons. Looks like another procedural trick they got away with.

2. Apparently it's not over yet.
A Federal Court judge ruled that Elections Canada was wrong to withhold reimbursements to two Conservative candidates.

But in an 84-page decision, Federal Court Justice Luc Martineau stopped short of ruling on whether the way the Conservatives transferred money in and out of local campaigns for advertising was legal, saying that is the subject of an ongoing investigation.

John Enright, spokesman for Elections Canada, said it will study the Federal Court ruling. Meanwhile, the investigation by the Commissioner of Elections continues.
