Could the petitioner who was turned down in NV move to a higher court?

It seems that the judge turned down the petition by incorrectly stating that in order for a recount to be done, it had to have the potential to change the results of the NATIONAL election. Wasn't that provision intended to refer to elections in which the state's tallies were very close, as NV's are? Isn't the provision referring to a change in the state's tally?
