Blackwell has former congressman arrested for trespassing!

Former county supervisor and former Congressman Hamburg (First
California District, 1994-6?) and his wife Carrie are Mendocino
County Greens. Dan, then a Democrat, was elected to Congress in 1994;
but abandoned that party after the local Demo machine neglected to
support his re-election. He is also a former Green Party nominee for
California governor, (1998).
Dan and Carrie's names are also on a renown legal case in
which 8 plaintiffs (mostly Greens) sued over being falsely arrested
at a protest against the Ukiah WalMart store in 2000.
WalMart recently paid the plaintiffs and their attorneys
$90,000 to end the lawsuit Hamburg vs. WalMart Stores Inc.
Last February, a state appeals court ruled that stores must
be able to prove trespass, not just believe it, in order to citizen
arrest petitioners who do not obey their guidelines. This is now a
published decision, meaning it sets precedent.
Not content with their victory at WalMart, the Hamburgs have
apparently sought out
more prestigious venues in which to be arrested.......

On Wed. Dec. 8th Former Congressman Dan Hamburg and his wife Carrie
were arrested at 12 noon while trying to deliver a letter to Sec of
State Ken Blackwell. During the press conference (see PR below) Dan
and Carrie entered the lobby of the private Borden building at 180
Broad St, where Mr. Blackwell's publicly funded office is on the 16th
floor.

from the US House Judicial Committee addressed to Mr. Blackwell
asking 34 questions about the Ohio election irregularities. Mr.
Blackwell was invited to answer these questions at a hearing at 10 am
this morning. Mr. Blackwell was a no show, so we invited him to our
press conference outside his office.



Because they were attempting to deliver the letter and a personal
invitation to our press conference Dan and Carrie were arrested for
trespass. This happened at the same time of the hearing going on in
Washington, D.C.

in Washington, D.C., new instances of fraud regarding machine voting
and voter suppression were detailed that Mr. Blackwell has not
answered. The hearing will now be moved to Ohio to gather more
evidence.



On Thursday, Dec. 9th at 11am until 5pm we will picket the Governor's
office at 77 S. High St. to demand Dan and Carrie's release and that
the Ohio Electors not vote until the recount is finished. We will
demand the removal of Mr. Blackwell as Sec. of State for delaying the
recount and creating a legal limbo for the Ohio election results.
Mr. Blackwell is the real criminal for suppressing the Black and
Student vote in Ohio, which is a felony according to Ohio state law,
civil rights law and the U.S. Constitution, 14th Amendment.



The Governor is accountable for the conduct of the election in his
state and will bear responsibility if there is not a fair recount.
He should remove Mr. Blackwell who is not doing his duty to be
impartial in overseeing the election and recount and not responding
to the US Congress.



Bring signs, noisemakers, drums and post this notice on lists and
spread the word.



On Friday, December 10, we will picket 11am -5pm and ask for a
meeting with the Governor.



On Saturday, we will precinct walk to gather evidence of fraud around
Franklin County. If you know which precincts had the longest lines

On Sunday, we will gather for a legal rally at the State House on
High Street at 12 noon and march to the Federal Building. We do not
need a permit since we will in public access areas and sidewalks.

1. Blackwell's dirty little games

It struck me as odd that Blackwell's public office is inside a private building as it would make things more difficult if people wanted to exercise their First Amendment right to assemble peaceably, and to petition the Government for a redress of grievances.

The article stated that the Hamburgs were arrested in a restaurant. Blackwell's office stated another private tenant in the building had called police. I was curious to know which tenant, so I made a few phone calls. The Columbus police said indeed, 3 people were arrested at about noon in a restaurant at 80 Broad St, which is the Borden building. I found out it was called Zuppa's Restaurant. I called the owner/manager and he said they had been arrested there but he didn't know who had called police.

Last night I called the police again and asked if they could tell me who placed the call. They searched their records and could find no record of the call.. very interesting, as a different person that morning had found it right away.

I think Blackwell's office DID call the cops, or had one of their buddy's do it for them. Funny thing is, the Supreme Court has ruled in the past on similar cases (U.S. Supreme Court PRUNEYARD SHOPPING CENTER v. ROBINS, 447 U.S. 74 (1980)) in favor of right to peaceful protest in a private "shopping center", and I believe the Borden Building would fall into that category.

4. It sure is...like a nightmare

But if the public keeps getting pounded like this, and having their rights taken away, it cannot go on forever. It is so important that people know about all the laws Blackwell is breaking. There must be a laundry list by this point. He should be arrested, like any of us would be if we broke the law.

3. I want to add...

It is good to be aware of our 1st Amendment rights when it comes to protesting. Peaceful protest, eg., simply asking to speak with someone (like Blackwell),passing out fliers, etc, in private shopping centers, malls, buildings with multiple businesses and offices, should be our right, ESPECIALLY if a tax-funded, public office is hiding inside a private building.

your best bet, do not present any obstruction to passers by and be careful not to present too much of a distraction to traffic. Malls are considered something of a commons but the owners will likely expect some sort of prearranged $ deposit for a table where you can only sit and not necessarily solicit.

But in the SCOTUS-Pruneyard case, weren't these people passing out fliers, not sitting at a table, and didn't the ruling give that the green light?

7. Im sure in the multiple precedents that is exactly what they did

and quite likely a useable strategy, but in our local mall where one of the biggest showdowns took place ($$$$$ settlement) people are "allowed" to set up a table after putting down a $50 deposit. What the mall security allows you to do at that table is fairly useless when people are consumed with consuming they dont have very inquisitive natures. I would strongly recommend a busy intersection and a sizeable crowd of associates with pertinent signage. And persistence. To me, this is all about performing an end run around the fascist media, and beautifully effective in that way.

8. Tables are next to useless

I agree. And way too passive for my tastes. Let me ask you, what do you think of this business of having a tax-funded, public office inside a private building? HAve you heard of this before? I have NOT. All ours, to my knowledge, are in public buildings. This just seems an intentional method of putting barriers between the people and their officials (or at least attempting to)...

Personally I would recognize no barrier myself. What the "law" chooses to do shouldnt deter the true patriot. If it did, I would be driving on the other side of the road, measuring my speed in kilometers per hour.

I am going to do a little digging on this. And I am pretty radical too when I get fired up. We "stormed" our local elections office a couple weeks ago because walking in circles with signs just doesn't do it for me.

11. Blackwell moved to Borden Building in 1999

In 1991 Robert A. Taft was elected as the 50th Secretary of State He gave up the seat in 1998 to run for governor. He won, and is still governor.

In 1998 Blackwell ran against Mark A. Hanni and Charleta Tavares for the office, and won, to become the 51st Secretary of State of Ohio.
