Link to OH election regs--MUST use verified paper ballot

for recount when an electronic device is utilized. It does not say if 3 percent of the vote matches no paper recount. Here is the link with access to all the regs. Am I missing something?

(A) For any recount of an election in which ballots are cast using a direct recording electronic voting machine with a voter verified paper audit trail, the voter verified paper audit trail shall serve as the official ballot to be recounted.





(B) Voter verified paper audit trails shall be preserved in the same manner and for the same time period as paper ballots are preserved under section 3505.31 of the Revised Code

1. Missing the voter verified paper audit trail

Some of the Ohio machines do not produce a paper audit trail at all. Some do, but it is not voter-verified, it's just a running roll of paper with the votes printed in a somewhat random order, no provision for the voter to see the paper and void it if it doesn't reflect his intended vote.

There is a lot of confusion with people talking about election computers. Punch cards and optical scan are both paper ballots that are read/counted automatically by computers. There were relatively few 'touchscreen DRE' machines used in Ohio. There were a considerable number of older DRE machines used - Danaher and Microvote. One issue is that with the paperless DRE machines, you can't be sure it recorded your vote the way you think you cast it, a separate issue is that all the votes, even paper ones, are counted up on machines whose programming is secret and controlled by corporations who are substantially unregulated and are often partisan.

Of course the board of elections are defined to be partisan - bi-partisan but still partisans as opposed to neutral. So when they choose a contractor or a machine, the companies who get chosen are likely to have partisan connections.

Before any voting machine is purchased, rented, or otherwise acquired, or used, the person or corporation owning or manufacturing that machine or having the legal right to control the use of that machine shall give an adequate guarantee in writing and post a bond in an amount sufficient to cover the cost of any recount or new election resulting from or directly related to the use or malfunction of the equipment, accompanied by satisfactory surety, all as determined by the secretary of state, with the board of county commissioners, guaranteeing and securing that those machines have been and continue to be certified by the secretary of state in accordance with section 3506.05 of the Revised Code, comply fully with the requirements of this section, and will correctly, accurately, and continuously register and record every vote cast, and further guaranteeing those machines against defects in workership and materials for a period of five years from the date of their acquisition.

Since it's obvious the machines malfunctioned at the very least...We can request them to pay for a re-vote...
