This is complete victory for the Democrats on the issue of a revote, though it will be appealed immediately and the remaining issues may well go forward (such as discovery) while the revote issue is on appeal.

2. That's all they can do is wait for another general election
assuming they ever win at trial. The case goes on, but Rossi has previously said he would never accept a judge installing him into office, he wanted his revote.

5. Will there be any discovery involving the machines?
This could benefit the Dems, if by doing so, Gregoire's margin would increase and Repub election fraud could be proven at the same time.

6. Because the counties were dismissed, it will reduce discovery
somewhat, because when someone is a party, they can be asked interrogatories (written questions) and requests for production (of documents) which are relatively easy to generate, relatively burdensome to answer.

However, as a nonparty, the counties will now need to be subpoenaed, which can also ask for documents, but questions are answered only under oath at a deposition, and the counties can seek a protective order from the judge before they produce anything or before anyone testifies if they think the request is otherwise burdensom or irrelevant.

As a result of the above, the issues in the case will now be at least somewhat narrower, and framed by the positions of the Republicans and Democrats and Secretary of State without too much influence by the counties. To what extent these issues involve electronic machines depends upon the strategic choices made by the Republicans and Democrats, as represented by chair Paul Berendt, paul@wa-democrats.org and David McDonald davidm@prestongates.com

Answer: No idea whether the electronic machines will be brought up or not. But because I believe the legal standard Rossi must prove is that the *certification* of Gregoire as winner was "clearly invalid" (and in my opinion this is different than the question of "did the election have problems?"), I would think that evidence regarding the electronic machines could be introduced to offset any evidence the Republicans proffer (if any) that the Democrats benefited from any particular irregularities anywhere.
