Election Assistance Commission (EAC) Hearing Provisional Ballots: Col OH
The U.S. Election Assistance Commission (EAC) will hold a public
hearing on the use of provisional voting in the 2004 election cycle on
February 23 in Columbus, Ohio. The hearing will be held from 1:00-5:00
PM at the Ohio State University Moritz College of Law.

If the intention of HAVA was to help registered voters to exercise their constitutional right, why shouldn't that voter's vote count for the races including federal, state, county, and local that were cast correctly and void those issues that were not cast in the correct location (they were in the correct jurisdiction for the majority of the votes they cast).

Testimony for the public hearing on provisional voting may be submitted in writing to EAC at testimony@eac.gov.

1. Is that the extent of their investigation into Ohio?

2. no not just OH, Check out the illustrious panel
from their website:

"We know that provisional ballots enabled more than one million
Americans to vote on Election Day 2004," remarked EAC Chair Gracia
Hillman. "These were voters who were eligible to vote, but without the
protection of HAVA, they would have been denied their right to cast a
ballot. Preliminary data collected from 41 states also shows that more
than 500,000 provisional ballots were not counted. It is important for
us to learn more about the successes and failures of provisional voting
in order to assist election officials in conducting this type of voting
in the future."

The public hearing will feature three panels comprised of state and
local election officials, academic experts on provisional voting and
representatives of voter advocacy organizations. Featured panelists
include the following:

*      Hon. Glenda Hood, Florida Secretary of State
*      Hon. Rebecca Vigil-Giron, New Mexico Secretary of State
*      Hon. J. Kenneth Blackwell, Ohio Secretary of State
*      Mr. Michael Vu, Director, Cuyahoga County Board of Elections (OH)
*      Ms. Cherie Poucher, Director, Wade County Board of Elections (NC)


Academics

*      Professor Dan Tokaji, Moritz College of Law, Ohio State University
*      Mr. John Lott, Resident Scholar, American Enterprise Institute
*      Professor Edward Foley, Moritz College of Law, Ohio State University


Voter Advocacy Organization Representatives

*      Ms. Kay Maxwell, National President, League of Women Voters

Man I hope they get blasted. Why is it they pick the most crooked election officials to oversee this process?

Who will be there to give testimony?

3. So people should testify about other states as well?
Do you know if this hearing is one of a series around the country, and, if so, when and where the others are?

Will someone be at this hearing to talk to the people who testify, get them to sign affidavits to be used in lawsuits, or at least get their contact info if they're willing to give it so they can be reached later? This seems very important to me.

5. this has not been clarified yet, although the email listed
allows individuals/groups interested in provisional balloting, to submit testimony. It is a great opportunity to get our voices heard. Some food for thought:

1. Allow provisional ballots to be cast as long as the voter is in the correct county.
2. Allow provisional ballots to be counted for all races for which the voter was eligible to vote, based on the voter's residence.
3. Clarify that a voter who requests, but does not receive an absentee ballot, may cast a provisional ballot.
4. Create a notification and appeal process for denial of provisional ballots.

very serious by commission members and can be submitted up to the time (1pm est) of the hearing-again:
Testimony for the public hearing on provisional voting may be submitted in writing to EAC at testimony@eac.gov .
2. this hearing is similar to congressional hearing and no individual /group participation will be allowed to testify.

14. They had hearings pre election too...
Deforest Soaries was the chair at that time, I believe. I don't have access to my notes at the moment.

Avi Rubin testified at some point.

Of course there was later that little article in some media about the voting machine manufacturers taking the commission members out to lunch.

Can we say "conflict of interest?"

interest in being the OH SOS and his role as Ohio Co-chair bu$h/cheney '04.
