Dear Bryan,
Please see NJ S701, or Chapter 88. Page 5 line 13.
Basically it allows an individual to seek relief in
court for any past, current, or future violation of
HAVA, title III, section 301.

There are 6 voting machines certified for use in NJ,
all 6 to the 1990 standards, None of them are
certified to the 2002 standards, as of 7-05-05
according to the NASED listing.

There is no proof that these 6 voting machines are
2002 complaint, and I seriously doubt that they can
meet the occasionally more stringent HAVA mandates.

These six voting machines should be considered for
ASAP decertification.

The Unilect Patriot DRE has been decertified in
Pennsylvania. The Patriot undervote rate in PA was as
high as 7.29%, versus an optical scanners undervote
rate as low as 0.29&, typically around 0.5%.

The Sequoia Advantage cannot be HAVA compliant--
1) Wheelchair access requirments call for the top of
the screen being no higher than 48". the top of the
screen on the Advantage is 58".
2) The Advantage write ballot feature is most likely
in violation of section 301 of HAVA.
3) The Advantage uses a Z80 processer, first produced
in the late 1970s, I believe the Z80 was used in the
Commodore 64 computer in the 70s. I am in posession of
Sequoia VP, Alfie Charles testimony to the EAC, in
2004. Mr. Charles states that the Pre election
simulated vote or Pre LAT, for the Sequoia Edge is
"in excess of 100,000" ballot positions. While the
Advantage Pre LAT is a simulated vote of only 25,00
ballot posotions. The FEC accuracy requirments (3.2.1)
call for immediate failure of a voting system if it
commits an error within about 26,000 ballot positions.

Many Voting "systems" have software or firmware
upgrades that are 2002 certified, For example:
Sequoias vote tabulaion software, WinEDS, has recently
been certified to the 2002 standards. this WinEDS
upgrade is not part of a voting machine. Dont be
fooled by a vendor showing you a 2002 certificate
number for a sub component. The entire system must be
2002 certified.

To my count, as of November, 2004, there are about
7699 voting machines in NJ that are not HAVA
compliant. None of them can used in a federal
election, unlesss the HAVA deadline is pushed back to
2007. Only congress can do that.

There is about to be a train wreck in NJ. I suggest
you avoid it.
