I'm thinking somebody ought to challenge HAVA directly as unconstitutional. The Constitution gives power over election systems to the states, not to the Congress. HAVA is an usurpation of that power.
In Pennsylvannia, Gonzo/DoJ is also assaulting states rights over election systems--opposing a law that requires voter approval of any big changes in the election system.
