Voting on computer screens is so vulnerable to massive fraud that Colorado's November election is "headed for a train wreck," says an attorney who is seeking to have the equipment barred at trial next week.

An expert would need just 2 minutes to reprogram and distort votes on a Diebold, one of four brands of computerized voting systems attacked in the suit, says attorney Paul Hultin. His firm, Wheeler Trigg Kennedy, has taken on the case pro bono for a group of 13 citizens of various political stripes

And he's not the only one alarmed as details of the case spread this week.
The Colorado Democratic Party on Thursday urged all voters to cast absentee ballots for the November election to avoid potential fraud, after a key state official said in a deposition that he certified the computer voting equipment even though he has no college education in computer science and did little security testing. .

Threat from hackers, viruses
Suit: BAN Computer Voting

http://www.rockymountainnews.com/drmn/elections/article/0,2808,DRMN_24736_4994042,00.html

National computing experts have advised against using computers for voting because they cannot ever be secure, Efaw said.

Just this week, Princeton University researchers experimenting with a Diebold model said that malicious software can modify all records. They said the software can be stored on a memory card and installed by someone in a clerk's office or at the manufacturer's in as little as one minute. They also found that viruses could spread the software to all the machines in a system.

Hultin said instructions for tampering with the Diebold machine have been posted on the Internet.
In June, the secretary of state's office warned counties with certain Diebold machines that an earlier experiment installed distorting code in just two minutes. In a letter, the office advised election officials to add three seals to the equipment so any tampering could be detected.

With this in addition to security procedures and post-election audits, "we have minimized this threat," wrote Holly Z. Lowder, director of the elections division.

14. Right - It's Not Just the Voting Machines - IT'S THE TABULATORS TOO!
Our new missionary work - and by tabulators, of course, we mean the people, machines, and software...

Can you imagine...they'll get worked up in the press then the you know what hits the fan.

That's a shame but lets rock & roll...get the word out on the real concerns - the entire ballgame, which includes

- voter suppression
- felon disenfranchisement
- other voter contraction strategies aimed at the poor, black, Latino, etc. etc. citizens who have a right to vote.

We are just starting...

Great point....

Voting Machines Hacked By A Chimpanzee

By Joseph Bacchus and Stacy Kaper
FOX News

Critics of the Diebold touch-screen voting machines turned their attention Wednesday from the machines themselves to the computers that will tally the final vote, saying the outcome is so easy to manipulate that even a monkey could do it.

And they showed video of a monkey hacking the system to prove it.

3. CO: Attorney Says State Headed for Train Wreck

Here’s the IMPLICATIONS, UNSPOKEN BUT PRESENT: the Republicans know how to commit fraud and they probably will in Colorado.

Suit: Ban Computer Voting

Attorney fears fraud, says state "headed for train wreck" in November.

His firm, Wheeler Trigg Kennedy, has taken on the case pro bono for a group of 13 citizens of various political stripes.

But deputy attorney general Maurice Knaizer says Colorado is protected against tampering because state law now requires a printout of each computer ballot. The printout can be reviewed by the voter and is kept at the machine for post-election audits and recounts.

34. WAIT A SEC... Voting machines are appliances, NOT computers.
At least according to Douglas county Colorado Election Supervisor, Sheri Muehlfelt:

County feels electors will like voting by eSlate
9/18/2006

Like voters in many areas of Colorado, including Denver, Douglas County voters are using new systems to cast ballots this November. In Douglas County, the eSlate voting system, made by Hart InterCivic of Austin, Tex., has replaced older-style voting machines and paper ballots.

The company says it supplied the machines to 46 Colorado counties, from San Juan County, with 597 registered voters, to Douglas County, with more than 150,000 registered voters. The company's Web site says the eSlate machines are equipped with voter-verifiable paper audit trail, able to record each vote cast on the unit.

Election Supervisor Sheri Muehlfelt said the introductory use of the machine, which is like an appliance rather than a computer by function, was relatively trouble-free in the primary election Aug. 8.

<more>

Last year, Utah's Lt. Governor said approximately the same thing about the Diebold machines as part of his spiel to convince county commissioners/councils to purchase the machines. Maybe election directors around the country now think that simply saying "voting machines aren't computers" loud enough and often will work for them, too, like it did for him.

Daniel Smith, the reporter, isn't quite buying it, though:

The demo was set up to be easily understood, especially if voters have any experience with a computer or other electronic devices.

http://denver.yourhub.com/CastleRock/Stories/Government/Story~126355.aspx

Blenders, toasters, waffle irons and other appliances are innocuous and don't threaten our democracy. Voting machines and tabulators do. Election directors should be treating voting machines like bombs, not appliances.

5. Mexico's Zocalo square bustles as crisis eases – Obrador Declared Presiden
Edited on Sun Sep-17-06 10:21 PM by autorank
The victor has been declared, Lopes Obrador - President of Mexico. The egregious election fraud and cover up by the "independent institute, the world press, and the lazy ass so called "left" in this country and elsewhere...all those nihilistic, cowardly efforts to deny the truth, all of them, have failed. More will come out, the ballots will be (a) burned, as planned, proving theft or (b) preserved, and allowed to prove theft. It is not over, not even close. More to come on the Craven Press here from Michael Collins.

Mexico's Zocalo square bustles as crisis eases – Obrador Declared President

MEXICO CITY, Sept 17 (Reuters) - Witness to a history of conquest, revolution and sacrifice, Mexico City's Zocalo square returned to bustling normality on Sunday after leftists claiming vote fraud ended seven weeks of sit-in protests.

Peanut sellers did a roaring trade and families on bikes sped across the giant concourse, occupied until Saturday by tents housing supporters of Andres Manuel Lopez Obrador, the leftist who lost July's presidential vote by an inch.

The end of the sit-in eased a political feud that has gripped the country since the election, which conservative Felipe Calderon won by only 234,000 votes out of 41 million cast.

A court rejected allegations of vote rigging and named Calderon president-elect on Sept. 5, deflating leftist protests.

Snip

"We've seen everything here, all human life," said Antonio Escudero, a 25-year veteran street sweeper in the Zocalo. In their last act in the Zocalo, tens of thousands of followers declared Lopez Obrador "legitimate president" at a rally on Saturday.

6. Mexico: “Zapatistas in Cyberspace” – The online social revolution WOW
Edited on Sun Sep-17-06 10:44 PM by autorank
The Zapatistas are the resurrecting of the social movement for justice and equality started by Emiliano Zapata. They began their online efforts in the mid 1990’s and have carried it forward through innovative lists and feedback ever since. They’re not surfing at internet cafes. They’re communicating from the juggles of central Mexico, the state of Chiapas primarily, on a regular basis to broadcast their program, get feedback, and form alliances. They’re an amazing group and one more example why the internet must remain free!!!

Overview

The revolutionary reawakening of Mexico
by Alan Woods
Saturday Sep 9th, 2006 1:04 PM

The revolutionary mass movement that has been brought into being in Mexico by the electoral fraud perpetrated in the Presidential elections has reached a point where clearly the power is there for the taking. If there were a genuine revolutionary party at the head of the masses we would be on the eve of socialist revolution.

By Alan Woods
Friday, 08 September 2006
http://www.indybay.org/newsitems/2006/09/09/18307351.php

The revolutionary upsurge in Mexico marks a new and dramatic stage in the Latin American revolution. On the very doorstep of the most powerful imperialist state in the world, the masses are moving into action on an unprecedented scale, posing a direct threat to capitalism and imperialism.

Mexico has not seen a movement like this since the expropriation of petroleum in the 1930s. The masses have shown an impressive level of militancy, organizational skill and discipline. Overnight, millions of workers and peasants have been brought to their feet and are fighting for their rights.

What an inspiring sight! What a marvellous example for the workers of all countries! This is the final answer to all those cowards and traitors who argued that after the fall of the Soviet Union, socialism was impossible and that the working class was no longer a revolutionary force.

Explosive situation

The struggle began on the electoral plane. The masses were determined to inflict a defeat on the reactionary bourgeois government of the PAN and evict the lackey of Washington, Fox, who had sold his country to the big US monopolies at bargain-basement prices. They rallied massively to the PRD and its leader, Andres Manuel Lopez Obrador.

8. ABRAMOFF-DIEBOLD-NEY TIMELINE: HOW THE GOP STOLE DEMOCRACY. From Dems Will
Talk about a block buster post. Dems Will Win tells us why Dems Have Lost. The brilliant time line is required reading for any American who plans to vote. It’s also a golden opportunity for any members of the press to get a clue as to the basic and perhaps larger story here. As I read this, I recalled Abramoff’s extremist right-political religious extremism connections. Check this group out. He’s there, Jack, with Ahamanson, original financier for ES&S. Mark Crispin Miller has written in detail about the role of religious extremists in election companies and shenanigans. Watch as this unfolds. Dems Will Win gave the carriage a shove down the steps, where it lands will be up to further elaboration but what a start.

From Dems Will Win http://tinyurl.com/rguge fh
Diebold Payment to Greenberg Traurig, Abramoff's Former Firm

In perhaps the biggest scandal of all, the GOP and Jack Abramoff conspired and successfully stole our democracy through extremely corrupt dealings between Jack Abramoff, Greenberg Traurig, Convicted GOP Rep. Bob Ney of OH, the White House and really the entire GOP Congressional Caucus, in order to foist the hackable Diebold voting machines upon an unsuspecting and trusting public.

This biggest scandal of all truly reveals the sad fact that you can’t trust Republicans. Period. And no one should ever vote for any Republican ever again, as a protest vote over this—the biggest American scandal of all times.

Why is it the biggest? Because the Republicans clearly and deliberately stole our democracy. Here’s the timeline that shows the criminal patter. Use these facts and links liberally in Letters To The Editor. We need to play up the Abramoff Scandal more than ever now that it INCLUDES DIEBOLD AND VOTE-COUNTING FRAUD.

1990s – Republicans and investment equity start several computerized voting machine companies, using proprietary software to hide the source code that actually does the counting. Diebold is centered in Ohio in Bob Ney’s district, providing many jobs.

2000 – Katherine Harris and the GOP take the close election in Florida and force through Bush’s stolen even though later tabulations show Gore won if all the votes had been counted. Paper ballots are discredited by the famous hanging chads, setting up the push for computer voting.

2001 – Ney’s Chief of Staff David Distafano turns lobbyist for Diebold and at least one other voting machine company. One of DiStefano's crows about his having "an insider's edge to hard-to-reach political officials."

2002 – $3 billion HAVA bill mandating computer voting is passed in the House, shepherded by Ney, Abramoff and Delay, helping Diebold and the other companies write the legislation. Abramoff and Greenberg Traurig also use the HAVA bill to squeeze the Indian Casino Tribes to cough up more bribe money for Republicans and in lobbyist fees, with Abramoff and Ney lying about Sen. Chris Dodd and his help on phony amendment to aid casino gambling in the HAVA bill. Abramoff and Ney e-mails show outright fraud and bribery.

2002 – Programmer Clint Curtis testified that he was asked in 2002 by GOP Rep. Tom Feeney to create vote-stealing code for voting machine, which he does. This software seemed to have been used in the 2002 stealing of Sen Max Cleland’s seat in GA.

2002- Distafano and partner Coffee rewards Ney with $20,000 in campaign contributions, starting in 2002. Abramoff has Indian tribes contribute tens of thousands of dollars to Ney and pay the notorious $100,000 for the St. Andrews golf junket.

2002 – Diebold and AccuPoll start paying Distafano and partner Roy Coffee $250,000 in lobbying fees. Diebold starts paying $275,000 in lobbying fees to Greenberg Traurig, Abramoff’s firm.

2003 - Ney prevents the mandating of verified paper trails for Diebold and the other companies.

2004 – “"in 2004 numerous news organizations reported that the RNC spent millions hiring a questionable company called Sproul & Associates to do voter registration. Election and law enforcement officials in multiple states opened investigations into this group upon published reports that that they hired temporary workers to register only Bush supporters, Pro-life supporters and Republicans. Thousands of voter registration applications collected from Democrats by registration workers paid for by Sproul & Associates were reported to have been destroyed in a number of states.”- Donna Brazile. http://www.democrats.org/a/2005/08/acvr_report_rid.php

2004 – Ney writes “Dear Colleague” letter against amending HAVA for paper trails. In a clever twist, Ney “argued at the time that paper records on such machines would somehow disenfranchise disabled voters, who had been cleverly afforded a special provision in the bill which mandated at least one disabled-accessable device in every voting precinct in the country. That device, of course, would be a paperless touch-screen electronic voting machine, like the ones made by Diebold, which, legislators, vendors and lobbyists would later proffer, were required to meet provisions of the Americans with Disabilities Act (ADA).” Ney also stops Holt’s bill to reform HAVA. http://www.bradblog.com/?p=2262

June 2004 – Diebold payment of $12,500 to Greenberg Traurig, Abramoff’s former firm. http://www.bbvdocs.org/moneytrail/greenberg.pdf

November 2004 – Massive Election Fraud in Ohio prevents voters from voting and changes counts through software. Kerry loses to Bush.

March 17, 2005 – First known use of the “American Center for Voting Rights” (ACVR} for URL domain registration. This day must have been when Republican operatives Mark F. "Thor" Hearne and Jim Dyke—from the 2004 Bush Cheney campaign--formed this PHONY Institute with an official sounding name.

March 21, 2005 – Two business days later, the ACVR GOP bag men testify at the House Administration Committee hearing, really a smokescreen by Chairman Ney, to cover up the stealing of the 2004 Ohio Presidential vote. They cook up imaginary voter fraud epidemic to distract from the real stealing of the 2004 vote in OH by the GOP.

9. Security Analysis of the Diebold AccuVote-TS Voting Machine from freedomf

Princeton has always been a leader in computing science. They were one of the major hubs on Bitnet way back and they continue to lead today. This is excellent and the timing is good. Hats off to the researchers on behalf of a grateful nation. We think you have done a great service. Now start to piece it all together….(next message).

Security Analysis of the Diebold AccuVote-TS Voting Machine

Ariel J. Feldman, J. Alex Halderman, and Edward W. Felten
Re-Post
http://itpolicy.princeton.edu/voting /

Abstract This paper presents a fully independent security study of a Diebold AccuVote-TS voting machine, including its hardware and software. We obtained the machine from a private party. Analysis of the machine, in light of real election procedures, shows that it is vulnerable to extremely serious attacks. For example, an attacker who gets physical access to a machine or its removable memory card for as little as one minute could install malicious code; malicious code on a machine could steal votes undetectably, modifying all records, logs, and counters to be consistent with the fraudulent vote count it creates. An attacker could also create malicious code that spreads automatically and silently from machine to machine during normal election activities — a voting-machine virus. We have constructed working demonstrations of these attacks in our lab. Mitigating these threats will require changes to the voting machine's hardware and software and the adoption of more rigorous election procedures.

The Unanswered Question: Who Really Won In 2004?

By DU Poster Autorank (Michael Collins;))

Posted at Democratic Underground
See also... this annotated thread. It’s all in the numbers

According to the vote tabulators, in the 2004 presidential election George W. Bush won a stunning victory that defied all odds, particularly those applied by unbiased statisticians. He won despite trailing in most state and national polls. He won despite an approval rating of less than 50%, usually the death knell for an incumbent presidential candidate. He won despite trailing in the three National Exit Polls three timelines from 4pm to 12:22 am (13047 respondents) by a steady 48%-51%, miraculously winning the final exit poll (with only 613 additional respondents, totaling 13,660). This poll was “weighted” (altered) to meet the reported election result on the assumption that the reported result was accurate -- quite an assumption. The final poll showed a stunning reversal of the Kerry 51%-48% poll margin, which had been measured consistently all day by the same polling group: major news/networks and polling firm Edison-Mitofsky.

The analysis of exit polls and documented fraud in this election began on the Internet. A number of academics posted detailed work showing the near-impossible odds of Bush overcoming deficits in the state exit polls and the National Exit Polls. Much of this analysis comes from “TruthIsAll” (TIA), a poster on DemocraticUnderground.Com. TIA has a background and several degrees in applied mathematics. Using various elements of the national and state exit polls and other data sources, he produces results that are thorough, detailed, sober and compelling. He shows ALL data and calculations, while encouraging others to check his math. Only once did he make a minor math error, after asking DUers to check his calculation of probability that at least 16 states would deviate beyond their exit poll margin of error and go for Bush. The answer turned out to be one in 19 trillion! The debates on DemocraticUnderground’s “2004: Election Results and Discussion” forum are legendary and have attracted observers from all over the Net.

Before the election, TIA produced a daily update of his Election Model site. On 11/1/04, based on extensive statistical analysis, he projected a Kerry win of 51.63% to 48.38%, using a combined average of national polls, and of 51.80% to 48.2% using a Monte Carlo simulation of individual state polls. After the polls closed, data from the Edison Mitofsky NEP survey (sponsored by the major television networks and CNN) was unintentionally released over the Internet. This was internal network data, embargoed from public use, data with statements like “Estimates not for on-air use” and “This page cannot be displayed.” The networks had locked down this data for their own use in an “electronic cover-up” that was offensive to those who knew the story. Luckily for all of us, Jonathan Simon downloaded the exit poll data and saved the CNN screen shots! The Edison-Mitofsky (EM)-Corporate Media (CM) “embargoed data” was available for anyone with eyes to see it and a mind to review it.

TruthIsAll immediately began analyzing and publishing analyses on the forbidden data. Looking at the demographics on the second to last E-M major network poll, he laid out the set of improbable circumstances needed for Bush to win: “To believe Bush won the election, you must also believe….” This post was cited by Will Pitt in a major blog, which gave it wide visibility on the Net. “KERRY WON THE FEMALE VOTE BY A HIGHER PERCENTAGE THAN BUSH WON THE MALE VOTE…AND MORE WOMEN (54%) VOTED THAN MEN (46%).” It was all right there, polling results that we were never intended to see. But this was only the beginning. There are over 100 individual analytical postings that demonstrate the tremendous odds against a Bush win. This high-level analysis dovetailed with and was confirmed by on-the-ground stories of voting rights violations all over the country, particularly in Ohio.

The key data sources for TIA’s analysis are the four EM National Exit Polls and the 50 state exit polls. For those who doubt the reliability of exit polling, there has been a trend toward accuracy within 0.4% since 1998. These Exit polls are endorsed heartily by international voting rights activists -- the Carter Center, for example -- and even the Bush administration, which used them, ironically, in the Ukraine elections to demonstrate fraud and call for a new election.

At 12:22 am on November 3, the national exit poll of 13,047 respondents showed Kerry to be the winner by 51% to 48%, matching TIA’s pre-election projection. The poll was “un-weighted,” meaning the EM and CM had yet to apply weighting “adjustments”: percentages and weights applied to all the demographic categories to match the poll results to the reported vote count! Imagine if this technique had been applied by exit pollsters in the first Ukrainian election to show victory for the incumbent, who had committed gross election fraud. Yet this odd technique of turning a poll into a ratification of the actual voting results was applied in the American election. The final exit poll, with 13,660 respondents, showed a stunning reversal of fortune for Bush. The poll results were “re-weighted” to create a Bush “victory margin.”

The odds against the deviations from the state and national exit polls to the final vote count are astronomical. In addition, there is the consistency of the “pristine” exit poll timeline from 4 pm (8349 respondents) to 7:30 pm (11,027) to 12:22 am (13,047).
In addition to the gender-based evidence cited above, TIA has shown that some weightings for the question “How did you vote in 2000” are mathematically impossible. For example, the final poll claims that 43% of all 2004 voters were former Bush 2000 voters. But 43% of 122.3 million, the number of votes in the 2004 presidential election, is 52.59 million, and Bush only got 50.46 million votes in 2000, approximately 1.75 million of them from voters who have since died. Therefore, Bush’s final poll exit poll numbers, WHICH WERE MATCHED TO THE VOTE, had to be off by 4 million votes.

The analysis also demonstrated that other voter statistics make it impossible for Bush to have won. Even if all Bush voters from 2000 showed up and voted for him, he still needed an additional 13 million votes. He didn’t get them from new voters and those who did not vote in 2000; those voters preferred Kerry by an almost 3-to-2 margin. Because of this, a Bush victory required that he must win a whopping 14% of Gore 2000 voters, all of whom had to return to vote in 2004. But Gore voters were angry; they came back to defeat Bush once again after having the election stolen from them.

Logical absurdities and inconsistencies in Election 2004 abound. The data, analysis, and narrative are available at (insert link) for open-minded individuals who want to form their own conclusions about “Stolen Election 2004.”

This work is just part of a comprehensive set of election fraud work and analysis provided by the dedicated voting rights activists in DemocraticUnderground.Com’s “2004: Election Results and Discussion” forum, a unique Net resource.

12. Ruling in Missouri Voter ID Case – CRUCIAL From freedomfries
Edited on Sun Sep-17-06 10:41 PM by autorank
The Voter ID requirements in some states are onerous. They portend to suppress from 10-20% of the vote among the poor, which is heavily skewed against the Dcmocratic party. This case was challenged in Missouri and we won. The judges ruling is attached. This was an example of both class and racial bias, since minorities are most impacted. Watch and see if this ruling stands. It’s not final. Also remember, election fraud has been, is and will continue to be a race crime. Whether it’s overt suppression, .e.g., ID requirements, location of precincts, bogus regulations, etc., or disenfranchisement of legitimate voters, e.g., former felons and felons, those removed as “felons” who have no record (Harris in Florida, 50k black Floridians removed with no felony record).

28. thanks for the highlight auto!
The voter ID requirement is also particularly onerous for women, because of the added burden to prove name change, if occurred.
Elderly Afro-American women are the backbone of the Dem Party in many cities. How many own a car???
Remember: according to compared bureau of motor vehicles records and voter registration records 240,000 registered voters in MO had no driver's license. 300,000 in GA. Hundreds of thousands in IN.
The voter ID, still pushed by the GOP in Congress at this very moment is not a footnote in voter repression history.

ACTION ALERT

DATE: September 15, 2006

TO: Concerned Parties

FROM: Bruce Gordon, NAACP President & CEO
Hilary O. Shelton, Director, Washington Bureau

NAACP CALLS ON CONGRESS TO OPPOSE DISCRIMINATORY BILL REQUIRING ALL VOTERS TO SHOW A GOVERNMENT-APPROVED PHOTO ID BEFORE VOTING
GOVERNMENT-APPROVED PHOTO ID REQUIREMENT WOULD CAUSE RACIAL AND ETHNIC MINORITIES, THE ELDERLY AND OTHER GROUPS OF CITIZENS TO LOSE THEIR RIGHT TO VOTE

THE ISSUE:
In the next few weeks, the House of Representatives may consider legislation, H.R. 4844, which would require all voters to show some form of federally-approved photo identification before being able to cast their vote by the year 2008. It would also require states to ask for documented proof of citizenship by the year 2010.

This legislation flies in the face of our right, guaranteed by the Constitution, to cast a free and unfettered ballot, as well as the recently reauthorized 1965 Voting Rights Act, which mandates that no state or municipality shall in any way infringe on our right to vote.

H.R. 4844 re-creates new obstacles in voting akin to a modern day "poll-tax" by forcing U.S citizens to pay for government approved ID that many of our most vulnerable citizens do not have or cannot easily obtain to prove their citizenship such as passports or birth certificates. The requirement that all voters present a photo ID before being able to cast a regular ballot will disproportionately disenfranchise African Americans and other racial and ethnic minority Americans, as well as, the elderly, individuals with disabilities, Americans living in rural areas, Native American voters, the homeless, and low-income people who are less likely to have or carry a photo ID. The criterion for establishing proof of citizenship may be impossible for some of our citizens to establish. Until recently, it was common in certain parts of the country for people to be born at home, without obtaining an official birth certificate. If H.R. 4844 were to become law, many of these American citizens would be completely disenfranchised.

To add insult to injury, the bill would do little or nothing to prevent actual instances of voter fraud. Nothing in the legislation addresses actual documented problems of election and voter fraud which continue to plague our electoral process and our democracy. These include the improper purges of voters, distributing false information about when and where to vote, stuffing ballot boxes, and tampering with registration forms, most of which are perpetrated by corrupt election officials, not voters. Rather, H.R. 4844 would only exacerbate the already existing problem of voter non-participation by erroneously removing or discouraging countless eligible voters, American citizens, from the process.

37. It's all about race and class now modified, It's all about race, class...
gender. Damn, these high level Republican planners are good. They really go for the whole nine yards. They do things the majority of Republicans would not approve and then, when challenged, they get their people to defend their nasty tricks because we're trying to 'cheat.' It's quite briliant and subversive of the process.

13. Appeal Filed in in CA 50th San Diego Case – From autorank
It ain’t over ‘til its over! Let’s hope it’s not “déjà vu all over again.” OK, I’m now out of catch phrases. The appeal here is fascinating. The initial case was not decided on its merits, it was decided based on jurisdiction. The judge said that Denny or any Speaker of the House reigns supreme despite any election problems, regulations, contest, or decisions in the states AFTER the Speaker swears in a member. So, if you have pictures of the sworn in candidate conspiring and then taking part in the plot to steal the election and an on camera confession, the Speaker not the local law prevails. This, of course, is insane. Will the California appeals process allow such an egregious violation of the state and local authorities rights to review elections? Keep watching. I can’t imagine that they will. San Diego is highly conservative, compared to the rest of California’s populous areas and the judge there is a neophyte on election issues, by his own admission.

Appeal to be Filed By Plaintiffs in Busby/Bilbray CA-50 Election Contest!
Election Nullification Rejected! As Plaintiffs Seek to Prevent National Use of the 'Constitution as a Weapon'!
Jurisdictional Issue, Previously Used to Dismiss Case, to be Challenged on Appeal!

Guest blogged by Emily Levy

The BRAD BLOG has learned that the plaintiffs in the Busby/Bilbray CA-50 election contest will be appealing the recent dismissal of the case by a San Diego judge. The appeal will be filed in California's 4th District court. Briefs are now being prepared and funds being collected for what may be a rather expensive appeal. Notice of appeal may be filed as soon as today.

Donations to the appeal can be made via Velvet Revolution.

The appeal is a rejection of Judge Yuri Hofmann’s August 29 ruling which echoed GOP claims that the U.S. House of Representatives, not the state courts or voters, have the power to determine the outcome of elections of members of Congress. In California’s 50th Congressional district in San Diego County, Republican candidate Brian Bilbray was announced to be the winner of the June 6 special election, flown to Washington and sworn in before all the votes were counted or the election certified. That, after reports were initially broken, and well circulated by The BRAD BLOG revealing that the Diebold voting machines used in the elelection were sent home with poll workers for overnight "sleepovers" in the days and weeks preceding the "bellwether" U.S. House special election.

Those sleepovers, in which election works had unsupervised access to the highly hackable, programmed, election-ready voting systems, were in contravention of both state and federal laws and led to a filing of an election contest in early July.

Says attorney Paul Lehto, who argued the plaintiffs' case in Hofmann’s court…

"Everybody would agree that every vote should be counted and yet the election was terminated with well over 10,000 votes still uncounted. Everybody would agree that you can’t end a basketball game with ten minutes left on the clock and yet that’s what the Speaker of the House did when they swore in Bilbray only seven days after the election and then claimed that what that meant was that everyone else except the House of Representatives was thereby rendered powerless to look into the election. The legal theories of the defendants attempt to turn the Constitution into a weapon to be used to terminate elections. The Constitution is supposed to protect We the People not be used against us."

Sort of reminds me of another great cry for social justice: J'accuseRichard Hayes Phillips has done the numbers in Ohio with Bob Fitrakis and Cliff Arnebeck from day 1. His work is exquisite and precise. He is a strong presence on paper and in person. He has now charged direct fruad in Ohio...and they want to burn the ballots...

33. A tremendous thanks to Autorank for this post--what a great resource!
Some notes:

Christopher Dodd: I don't know any of the details of Abramoff/Ney falsely accusing Dodd of being involved in the Indian tribe bribes (in the time-line above), but Dodd was a key player in the destruction of our election system, through the passage of HAVA. He is a Bilderberg 'Democrat' (hangs out with global corporate predators), and he is now "exploring" a run for president, announced on the Al Franken show a couple of weeks ago (with a substitute host). He said that Hillary is in trouble with the "anti-war crowd," and that we don't want past "losers" as the candidate in '08 (Gore, Kerry), and, by a process of elimination, that leaves him. Mr. Diebold. Dodd was Kerry's adviser in '04 on electronic voting (talk about the fox guarding the hen house!), and was more than likely responsible for the big Democratic Congressional vote in favor of HAVA: All but 2 Democratic Senators voted FOR it, and all but 60 or so Dem House members.

Democratic Party collusion/corruption on HAVA: One of the posts above says we must never trust Republicans again. True enough. But we also have a serious problem with the Democratic Party leadership on electronic voting. We must never forget the MIND-BOGGLING SILENCE of our entire Party leadership on this matter, and the IRON CURTAIN they placed on ANY discussion of election fraud, as well as horrid items like the Calif Dem Party legislative leaders' collusion with Bushites in getting rid of our anti-Diebold Secretary of State Kevin Shelley and installing Diebold shill Bruce McPherson (APPOIINTED by Schwarzenegger). Further, it is the official position of our Party that optiscans are okay--it's the touchscreens that are the problem. I suspect this is Dodd's influence. It is the fallback position of the Corporate Rulers--they retain control of election results, even if touchscreens are banned, because the entire system--touchscreens, optiscans and central tabulators--is run on TRADE SECRET, PROPRIETARY programming code. (Optiscan ballots aren't worth the paper they're printed on, if there is no audit, or inadequate auditing.) The Democrats are more of a mixed bag, as to motives, than the Republicans. Some were/are scared--and justifiably so (--it was the Anthrax Congress that passed HAVA; and Kevin Shelley was a lesson to all in what will happen to you if you oppose non-transparent, unverifiable elections by Diebold, ES&S & brethren). Yes, it was a Bushite Congress that passed HAVA--the worst piece of crap legislation ever to come out of a U.S. Congress. BUT OUR PARTY SUPPORTED IT. And our party's corruption on this matter is WHY we HAVEN'T BEEN ABLE TO CORRECT IT.

The Diebold Congress: The current Congress is illegitimate. Most members of it were (s)elected by Diebold et al. Above, it's noted that the House of Reps is considering a bill to restrict voting rights by means of Voter ID. This is NOT a legitimate Congress, and we should NOT refer to it as if it was. Some members are true representatives of the people (were elected in states like NY with the old, reliable lever machines, or Oregon, with all mail-in voting, or were not Diebolded because they were too popular, like Barbara Boxer in Calif, etc). Most are NOT. As with the Anthrax Congress ("anthrax" pointing to the FEAR prevalent during that Congress), I believe that the epithet "Diebold" should be placed in front of the current "Congress"--i.e., the Diebold Congress--most especially when an anti-democratic or un-constitutional piece of legislation is being considered or passed. It is the DIEBOLD CONGRESS that is considering restricting voting rights with a Voter ID bill. This is yet another fallback position of the Corporate Rulers. If they can't hang onto DIRECT control of our election results, via Diebold & co. they will fiddle our elections by eliminating as many votes of the poor as they can. Legislation like this is purely an expression of the Corporate Rulers, and not of the people. The representatives of Corporate Rule were Diebolded into office IN ORDER TO pass legislation like this. This Congress should NOT be described in normal terms as representing the people. And if they fiddle the November elections--and I don't see how it can be avoided except by massive Absentee Ballot voting, and good follow-up on AB vote counting by the Democratic Party--then we should refer to it as the Diebold II Congress.

Hillary Clinton and Charles Schumer: We may not love these two on most issues, but it is a fact that these were the ONLY two U.S. Democratic Senators who voted AGAINST HAVA. Go figure. And I think it's interesting that Christopher Dodd, one of the chief architects of HAVA, has been lurking on the sidelines, gleefully watching "the anti-war crowd" pick Hillary to pieces, and waiting for the chance to spring himself upon us as our "only" choice. I'm not a Hillary fan. Really, I'm not ANYBODY's fan these days (except TIA's and Autorank's and Landshark's and Brad Friedman's and the other REAL leaders of this country! --our Thomas Jefferson's and Tom Paine's and Paul Revere's!) But Hillary's vote against HAVA makes me feel that, of all the potential candidates that would be acceptable to the Corporate Rulers, she is one whom we could successfully lobby on election reform, as a "good government" issue. And, much as I oppose the war on Iraq and MORE Mideast war, I think election reform is by far the more important matter for peoples' activists, since it is only by voting in transparent, verifiable elections that we can influence government policy. 56% of the American people opposed the war on Iraq, way back in Feb. '03 before the invasion. That is an astonishing amount of opposition so early on. If Bush hadn't been assured "re-election" by means of HAVA, he could not have proceeded with that illegal war. The key to stopping the war and other fascist crimes is transparent elections! We may well have to put up with a Democrat who is NOT chosen by us as our candidate for president in '08. And all I'm saying is that, of the candidates NOT chosen by us (if we still have a Diebold system at that time), we should gage our support of candidates in the primaries on the potential for election reform, as our first priority. And, whatever happens, we should aim all of our energy on election reform--even if there is more war, a Draft, and more fascist outrages or inadequate reform on other issues. NOTHING is more important than restoring our right to vote, however we can accomplish it.

THE ABSENTEE BALLOT PROTEST: I am encouraged by the call by the Colorado Democratic Party for Absentee Ballot voting. As a method of achieving accurate vote counts this fall, it can only work if there is good followup by the Dem Party on how AB votes are handled. Let's hope this becomes the universal call of the Democratic Party nationwide--and that good followup on vote counting occurs as a result.* I have called for AB voting as a PROTEST--a method for the citizenry to express their profound distrust of these electronic voting systems, and--if the protest is big enough--of pressuring local/state election officials to throw these election theft machines into 'Boston Harbor' where they belong. If everyone who despises the Bush Junta votes by Absentee Ballot--65% to 70% of the people--the reign of these diabolical machines is OVER!

--------

*(There are problems with how AB votes are handled. Some election officials count them last, and report e-voting totals first. Thus the corporate news monopolies can "call" an election on the e-vote. In other cases, the AB votes are just scanned into the rigged electronic system and are no more secure than an optiscan vote. This is where the Democratic Party could really do some good--by close monitoring of the way AB votes are handled and counted. AB votes are NEVERTHELESS a good PROTEST vote! It is a BOYCOTT of the machines! It may not get us accurate vote counts--that may be impossible--but, if enough people do it, we can FORCE REFORM, and save the '08 primaries and general election from Bushite corporate control of the results.)

35. Outstanding summary of very important issues.
Edited on Mon Sep-18-06 05:39 PM by autorank
And unlike yours truly, you use spell check consistently.

We can't trust, only verify. The Dodd-Hoyer co sponsorship of HAVA 2002 was a disaster in retrospect. I see it as naive. I see their perseverance in support as total fear. When the goods are put on the table for this heist, somebody is going to get blamed. Rightfully, they're fearful that they will take the fall because they were at the "scene." The best thing to do is get out front and come clean. If I were them, I'd say:

"We hoped this would end voter suppression through "spoiled ballots," which the machines promised to do. That's been a problem for minority voters for decades - lousy equipment in primarily minority districts costing 2% lost votes due to "spoilage" a year. We had no idea there would be so much deception and deliberate failure, all to the benefit of our opponents. We're introducing legislation to repeal HAVA and replace it with a uniform paper ballot system. We're also going to go after any voter suppression and disenfranchisement immediately through publicity, then legislatively and with legal actions also. We're truly sorry."

Now, that's not 1/2 bad is it. We wouldn't believe the history but if they did what they said, we'd happy. They won't. As the DC saying goes: "it's not the crime, it's the cover up."

Thanks for the reminder about Hillary and Schumer...that is an excellent point.

Great post.

I almost forgot...when I saw the Caolorado call for absentee ballot voting I immediately thought of you...you kicked that off here and really ran with it. I'll bet some of that energy and thought is a ripple effect that impacts the larger universe out there, you know the three dimensional world.
