Mark J. Grisanti moved another step closer to becoming a state senator Tuesday, as he maintained
a 527- vote lead over Sen. Antoine M. Thompson following a marathon session of paper ballot counting in the Erie County Board of Elections office.

A week ago, Democratic lawyers were certain that voting machines in Erie and Niagara counties had enough problems to persuade a judge to order a
hand-recount of all 51,000 votes cast on the machines on Election Day.
But by last weekend, that plan had rapidly faded.-snip-
Senate Democratic sources say that Thompson would need to get within real striking distance ... one official put the number at about 200 votes behind Grisanti — to stand a chance of getting an order to hand-count the machine votes.

Republicans have dismissed those possible legal maneuvers as mere delay tactics for the inevitable: a GOP takeover of the 62-member Senate.
“We’re in the minority,” conceded a top Democratic Senate official who spoke on condition of anonymity.Thompson’s team of election lawyers dispatched from other parts of the state also has dwindled.
