Lohan sentenced to four months jail for theft

LOS ANGELES (Reuters) – Troubled actress Lindsay Lohan pleaded no contest on Wednesday to stealing a necklace from a Los Angeles store in January, and was sentenced to four months in jail.

Lohan, who was not in court, entered the plea through her lawyer on a reduced, misdemeanor theft charge.

Under California law, a no contest plea is effectively an admission of guilt. Lohan, 24, who has been in and out of jail and drug rehab for almost four years, had previously pleaded not guilty, insisting on her innocence.

The judge in the case sentenced the "Mean Girls" actress to 120 days in jail and 480 hours community service. Lohan was told to report to jail on or before June 17.

In essence, the argument runs along the lines of "you all have put so many people who couldn't afford proper representation on minor possession charges in prison that my client actually does you a favor by not contributing to the overcrowding problem." Entitled bourgeois cockroaches. Serving a sentence at home, what kind of shit is that. Revolting.

7. In this case, I really felt the prosecution's case was weak.
Lohan was probably just stoned and spaced out of the store with the necklace. Note that she left MORE valuable jewelry behind, in the store, on the counter.

She is a beautiful woman but very messed up. Which is apparently quite common in Hollywood. Sad, but true. One can only hope she doesn't end up like so many others.

10. Be "Stoned" is NOT a defense, it is NOT even a mitigating factor
Now, if she could prove SOMEONE else drugged her, then that is a defense, but if she took the alcohol or drugs herself, being stoned is NOT a defense. The law act as if you were stone cold sober in advent like this. It is one way to address the problem of excess use of Alcohol and/or drugs.

15. As a Juror you have that right, but as a matter of law being stoned is NOT a defence.
And this was a case in front of a judge NOT a jury, so not an issue.

9. Neither belongs in jail.
The real Lindsey and the fictional Lindsey Smith both need to do plenty of community service. It needs to be hard work and supervised. What the hell is wrong with this country? Why do we love to punish people so much and how is jail time going to help anyone?

11. She is not going to jail.
She is going to serve 14-16 days at her home under "house arrest". Somehow I don't think it will be too traumatic.

13. So I read. I am just making the point that a young girl with drug...
problems who basically shoplifts doesn't belong in jail. It doesn't matter if she is poor and black, rich and white or visa versa. It's ridiculously expensive and over-reactive to send someone to jail instead of dealing with the problem effectively. Counseling, education and enforced and directed community service would cost a fraction of incarceration and it might even help instead of make things worse.
You sound pretty pissed that she is getting away with this terrible crime so easily. Is it because you think it's unfair that less fortunate people are punished more harshly? Do you just not like her? What's up with the need for punishment?
