Playboy model sues Journey guitarist over claims of marriage-like deal in Marin

http://www.mercurynews.com/entertainment-headlines/ci_19398518A former Playboy Playmate has filed a lawsuit against Journey guitarist Neal Schon, claiming he owes more than $25,000 for their ''express oral nonmarital relationship agreement" when they lived together in San Anselmo.
Ava Fabian, the Playmate of the Month in August 1986, filed the lawsuit in Marin Superior Court. Fabian alleges breach of express contract, constructive trust, money ''had & received," intentional infliction of emotional distress and ''quantum meruit" -- payment for services performed in the absence of a contract.
Fabian, 49, said she and Schon lived together ''in a marriage like relationship" from February 2010 to September of this year, accumulating joint property and income. Schon, 57, agreed to support Fabian during the relationship and, if it ended, provide additional support for ''a period of time," the lawsuit says.
In return, Fabian claims, she ''devoted her sole time, and energy" to managing Schon's affairs. Her efforts included making the residence ''presentable for parties and gatherings," attending to Schon's mother and his children from other relationships, and attending ''to his every need to the detriment of her own career and livelihood," the suit says.
