The couple, Peri and Tamela Rainbow-Sloan, of Stone Ridge, obtained the benefits through the State University of New York at New Paltz, where Peri Rainbow-Sloan is a professor of women's studies. The state Civil Service Commission granted the couple the benefits after they were married in a legal ceremony in Canada in 2005.
In a ruling dated Jan. 22, a panel of the Third Department of state Supreme Court in Albany rejected a suit brought by an Arizona-based group, Alliance Defense Fund, challenging the couple's right to obtain the state health insurance. The plaintiffs contended that since gay marriage is not legal in New York, gay couples who live here should not be afforded such coverage.
The appellate court ruled that because same-sex marriage is legal in Canada, New York is legally bound to honor it.
