A federal judge has dismissed a suit by a transsexual woman who was fired from her job at the Utah Transit Authority for using the woman's washroom.

Krystal Etsitty, 42, is in the process of transitioning. She is undergoing hormone therapy, wear's women's clothing and presents herself as female.

Etsitty sued under federal sexual discrimination laws.

1. I think there's a really easy solution

I'm not comfortable with unisex bathrooms in the workplace because the stall doors have huge gaps at the hinges and latch - when you walk by, if you don't avert your eyes, you're basically watching the people use the toilet.

If they fixed the design so people had actual privacy, this wouldn't be such an issue.

How hard would it be to just get an insert that fits in those gaps - a rubber flap sort of deal that is flexible enough to open with the door, but prevents people from seeing in?

If I was an entreprenuer, I'd figure out a way to produce and market those. All anyone wants is privacy when they're on a toilet - and most people I know would like it even if there are just same sex people in the bathroom anyway.

...the MEN's bathroom??? GMAB. Can you imagine the stir if she were caught by the guys in their bathroom? So, she is not suppose to use the ladies bathroom and using the men's with her appearance most likely is out of line ~ what now? Just not use either bathroom all day??? There HAS to be a freaking better solution than than firing her. And, yes, to me she is a "her." That is HOW she presents herself and she should be accepted as this. I would not have had one problem at all with her in the ladies room...but then... that is just me.

The U.S. is ridiculously hung up on segregation based on a bias toward binary gender divisions that simply do not exist.

It's nobody else's business what gender a person considers themselves to be - the whole construct is stupid and dehumanizing.

Sometimes I feel like telling a lot of people in the U.S. to grow up. They act like they never got past giggling at bathroom jokes in the first grade. Unfortunately, it's not a laughing matter when people are harassed and murdered because of some moran's perception of their personal identity.

6. Why we need GLBT rights

Neither orientation nor trans are protected under federal civil rights laws. I don't know that the Judge had much room for choice in this case. If she was legally male. Then the laws governing sexual harrasment might protect her from being fired for wearing a dress. But I don't see the statute protecting the right of a male to enter a designated female only area.

This points out the need to change federal laws. We need to legislate protections for both sexual orientation and gender presentation. For which today there are no federal protections.
