I present to you the fine folks of Stop the Amendment (Indiana):
http://www.stoptheamendment.org/118 members of the Indiana Legislature voted to make domestic violence more difficult to prosecute.ARTICLE 1 OF THE CONSTITUTION OF THE STATE OF INDIANA IS AMENDED BY ADDING A NEW SECTION TO READ AS FOLLOWS:
Section 38. (a) Marriage in Indiana consists only of the union of one man and one woman. (b) This Constitution or any other Indiana law may not be construed to require that marital status or the legal incidents of marriage be conferred upon unmarried couples or groups.
What This Means
As we have seen in other states that have passed similar resolutions, the language in this proposed amendment would tie up our court system with challenges arising from the undefined "legal incidents" of marriage. For example, in Ohio and Utah it is now unclear if charges of domestic violence can be brought against individuals who abuse their unmarried partners.
An Ohio state judge has since reduced the domestic violence conviction of a man who assaulted his live-in girlfriend, arguing that protection under Ohio's domestic violence law is a "legal incident" of marriage and is therefore now afforded only to married individuals.
