Oregon Gay Marriage Amendment Returns To Court

Lawyers for same-sex couples want a judge to strike down Oregon's constitutional amendment barring gay marriage.

They, and attorneys for the group that pushed through the amendment last year, return to court Monday.

Voters last November approved the amendment but Equal Rights Oregon maintains that the question on the ballot violated state law by being so broad it affects a host of other rights.

1. The constitution is, by definition, constitutional

If the voter-approved change to the state constitution interferes with a host of other rights, then those rights must fall. If the people start screaming, then they must again change the state constitution.

Personally, I think the best thing to happen would be if the Oregon Supreme Court said, "There is no basis for claiming that voter approved amendments to the state constitution violate that constitution" and then proceeded to overturn citizen rights based on that amendment. Let the bigots squirm a bit and see how it feels. Then let them undo the damage they themselves have done.
