Nebraska Judge Rules No Same-Sex Marriage Means No Same-Sex Divorce

Otoe County District Judge Randall Rehmeier ruled that a lesbian couple married in Vermont eight years ago couldn’t get a divorce decree in Nebraska, because Nebraska only recognizes heterosexual marriage. The judge said Nebraska Constitution provides that “only marriage between a man and a woman shall be valid or recognized in Nebraska,” and since the state does not recognize the marriage, he does not have jurisdiction to dissolve it ...

1. Gay marriage in Nebraska
I guess technically this is true. he doesnt have the authority to dissolve it. but couldnt he set a precedent by doing so? making gay marriage recognized by the state?
