Apparently since we've been able to successfully change hearts and minds in Congress, our battle is no longer desperate enough to warrant judiciary involvement.
In a motion filed last week to the U.S. District Court in San Francisco, attorneys representing the House say that gay people "are far from politically powerless," true, but irrelevant. We lack equality. Which means we are legally powerless in many instances. They further claimed that we aren't like other groups who were discriminated against saying they can't see us facing "discrimination
is unlikely to be soon rectified by legislative means" We'd rather not take our chances with y'all.
"The very significant gains made by homosexual-rights groups both in legislative terms and in popular opinion -- and the phenomenal speed at which those victories have come -- demonstrate that they have ample ability to attract the favorable attention of lawmakers," reads the 36-page brief filed by Bancroft PLLC, the firm defending DOMA.
