RYE — A bipartisan group of high-ranking U.S. officials, including Democratic Leader Nancy Pelosi and Republican Speaker of the House John Boehner, is prepared to fight legal efforts to obtain military benefits for same-sex couples.
Rye residents Charlie Morgan and her wife, Karen, are two of 16 plaintiffs named in a federal lawsuit seeking "the same recognition, family support and benefits" for same-sex couples that the U.S. military provides for heterosexual couples.
The 12-count suit, filed in the U.S. District Court of Massachusetts, alleges gay and lesbian service members, and their families, are victims of unconstitutional discrimination. The suit asks a judge to rule that the federal Defense of Marriage Act "is unconstitutional, as applied to military spousal benefits." Morgan is a lesbian member of the N.H. National Guard.
In a notice filed with the federal court Friday, the Bipartisan Legal Advisory Group of the U.S. House of Representatives states its intention to intervene in defense of DOMA. The group notified the court that it will seek to intervene in the lawsuit if the federal Justice Department decides to defend military benefits for military members and their same-sex spouses.
