New Hampshire Mulls Gay Marriage Ban

Gay marriage already is illegal in New Hampshire, but legislators today will hear a proposal to ban same sex unions through a constitutional amendment.

The resolution, which seeks to ensure that “a marriage between one man and one woman shall be the only legal union that shall be valid or recognized” in New Hampshire, needs to pass the House and Senate by a three-fifths majority to make to a November ballot. It would then need a two-thirds approval by voters to pass.

Turnout for this morning's hearing was expected to be large and vocal - the House Judiciary Committee reserved Representatives Hall from 10 a.m.
Rep. Nancy Elliot, R-Merrimack, a sponsor of the resolution, and a Judiciary Committee member, said a constitutional amendment would keep a gay marriage decision out of the courts.
