A woman whose children were taken from her because she is a lesbian has won a 10 month legal battle to get them back.

In a unanimous decision an appeals court ruled that a family court judge erred in removing the two children, ages 4 and 6, from Amber Crosby's custody.

Last February Judge Herbert Kernaghan Jr. ordered the children removed after the Richmond County Department of Family and Children Services reported that Crosby's domestic partner beat her in front of the children and that the couple took drugs in front of them.
