HPV Vaccine Victim Sues Merck

Naomi Snell, a 28-year-old woman in Melbourne, Australia, is leading a class-action civil lawsuit against drug maker Merck after suffering autoimmune and neurological complications following injections with the HPV vaccine, Gardasil.

After receiving the first of three doses of the vaccine, Naomi suffered convulsions, severe back and neck pain, and lost her ability to walk.

Doctors actually diagnosed her with multiple sclerosis, which was later retracted and labeled a neurological reaction to the vaccine.

Seven other women, who say they have suffered various physical problems, including anaphylaxis and miscarriage, after receiving Gardasil may also join the civil lawsuit, and this is likely only the beginning, as Gardasil is being implicated in a growing number of serious, permanent and sometimes deadly adverse reactions.

I refuse to argue about this.

As I've said numerous times the FACT is:

"It is important to know, however, that over 90 percent of women infected with HPV clear the infection naturally within two years, at which point cervical cells go back to normal."

The reason why the mortality rate is so low is because -- for the vast majority of healthy women living in developed countries like Europe and the U.S. -- their immune systems are usually strong enough to naturally clear HPV infection within two years. Of course, even if you get HPV vaccine, if you contract one of the 40 or more types of HPV that are sexually transmitted and aren't included in the vaccine, you will not be protected from HPV infections. And, if you've already been exposed to one of the four types of virus in the vaccine, it doesn't work against those either.

This means that, even if you accept the risks and get vaccinated, your chances of experiencing some form of HPV infection are still very high. Whether or not the HPV virus will lead to genital warts or cervical cancer or other kinds of health problems, however, depends in large part on the state of your immune system and, in the case of cervical cancer, is affected by whether or not you get routine PAP screenings."

Further, Judicial Watch, a public interest group that investigates and prosecutes government corruption, recently issued an update on adverse reaction reports relating to Gardasil.

They are an explicitly right-wing group, who are particularly obsessed with illegal immigration, 'the unprecedented explosion in the size and reach of the government', the evils of ACORN, and of course President Obama. Their 'Ten most wanted corrupt politicians' list includes two token Republicans, and eight Democrats including Obama and Pelosi. They are obsessed with the evils of Obama's judicial nominations, especially Kagan and Sotomayor.

In a recent article they state: 'In a preposterous act that could set a dangerous precedent, Los Angeles officials have offered protestors from the movement to end economic segregation and social injustice prime downtown office space, housing and public land to farm.. It marks the beginning of legitimate negotiations between an established government entity and the often violent, leftist “Occupy” movement that’s paralyzed cities nationwide to denounce corporate America’s unjust treatment of minorities and the poor. In New York more than 150 people were arrested and several police officers suffered injuries. In Oakland California police were forced to use riot gear and tear gas to disperse the huge, violent crowds and in Las Vegas nearly two dozen protesters were arrested...

Before you know it the feds will follow L.A.’s lead by offering Occupy protestors a national headquarters near the capitol and maybe even health insurance and other benefits'.

They have all the hatred for 'Obamacare' that you'd expect of a right-wing organization, and comments have ranged from: 'Although it’s illegal to fund abortions with federal dollars two states will pay for the life-ending procedure with federal funds under President Obama’s new healthcare reform law.' to 'Emphasizing Americans’ disdain for the president’s hostile takeover of the nation’s healthcare system, lawmakers who voted for Obamacare got the big boot in the 2010 midterm elections.' and crucially 'Judicial Watch has an ongoing investigation into Obamacare that includes more than 20 public records requests to unearth details of the degenerate, backroom deals that ultimately resulted in the law. Among them are secret, closed-door meetings held by the president and vice president with Health and Human Services officials, former House Speaker Nancy Pelosi, Senate Majority Leader Harry Reid and union officials.'

It seems that they have a general opposition to government provision of healthcare (i.e. they are MONSTERS OF PURE EVIL), and opposition to Gardasil is just part of that.

6. Ah the old - I don't like the source even if they cite/link to studies, therefore it is not real
defense.

I say on newsmax that our President was Obama, but I don't trust them as a source, therefore, he is not.

11. Well, the study isn't really the story here--the LAWSUIT is.
Once that gets underway, all will be revealed. There's no need to argue the case here, professionals will do it in court.

15. Yes, that may be so--but the OP is about the lawsuit, and the lawsuit
will, like it or not, play a role in future distribution of the vaccine, if indeed plaintiff prevails and it is upheld on appeal. That will embolden others in other nations to take the same steps. Precedence might be set.

In any event, there will be medical testimony and it likely will include studies, doctor's diagnoses, and patient testimony.

You say "Lawsuits are a dime a dozen"--this is the first one I've heard about--class action or otherwise--against Gardasil. If there are others, how have they turned out?

19. Except the actual science matters more than the court opinion
Much like the teaching of creationism isn't allowed in most areas because it doesn't have a scientific basis, if the science doesn't support the claim being made here then the court ruling is effectively garbage.

25. Not always. Ask the courts of Saudi Arabia which counts more--
science or the opinion of a bunch of assholes in robes?

What will count, at the end of the day, is what the jury will say, and if what they say is, if needed, upheld on appeal.

Juries can nullify evidence, and they often do. Even here in the USA. I imagine Australia and other nations aren't immune to the phenomenon, either.

28. Well, the class action isn't happening "here" either. It's happening halfway across the world.
Sheesh, yourself. Too clever by half. It wasn't a "distraction" it's a key aspect of the OP--unless you're confident that Australian law is equal in every way, with the same rules of evidence, as US law.

24. A lot of those links are to shyster lawyers. Like I said, I have not seen a CLASS ACTION to this
point. The odd individual case, sure, but a CLASS ACTION is a different thing altogether.

I would guess Merck isn't being quite so dismissive.

The point is that it's easy to find several other lawsuits.

And now you're bringing up "class action," as if that had something to with anything.

The evidence of safety for this vaccine is extremely strong. Tossing stories about individual lawsuits does not change that.

29. Look, there is a huge differencce between an individual lawsuit and a class action lawsuit.
Class action lawsuits open the floodgates to other class actions. They can result in massive settlements to millions of "members of the class" and they can put a company into receivership.

If you don't get that, you need to "cut the crap" and maybe get a little background on the topic.

Listen--I could give a shit about "the safety of the vaccine." I don't care if it is safe, OR NOT. I have no "stake" in the outcome, so I don't understand why you are acting like an ass and trying to place me on the "AntiVaccine Team." I have no fucking opinion, capisce?

My position is this--IF the suits prevail, this could cost Merck a bundle. That is ALL I AM SAYING.

Now, can YOU "cut the crap" and stop accusing me of holding a view I don't hold, and digest what I'm actually saying instead of painting a nonexistent "adversary" tag on me?

Cervical cancer is treatable. The adverse effects of Gardasil often aren't.

20. Cervical cancer is curable about 2/3 of the time. There are still many who die.
And those who are cured have to suffer painful treatment, and are usually left infertile and sometimes with other problems.

Far fewer people seem to suffer serious effects from Gardasil.
