"citing cases he could face on the high court" - The Roberts dodge
In using the argument that he cannot answer questions "citing cases he could face on the high court", Judge Roberts has set an impossible barrier to getting any question answered.

As far as I know, he has no precognizant ability (ESP to the lay person; see ability to pick winning lottery numbers), so he has absolutely no idea what cases he may face in the decades he could serve on the SCOTUS.

He has laid the groundwork to effectively plead the "Fifth".

If I were a Senator on the hearing, I would ask him exactly which cases he forsees facing on the High Court. I would ask him about every possiblity of a case he could face.

Overturning slavery? Women's right to vote? Every amendment save the second? Trial by jury?

What the hell difference does cases "you might face" mean. Just give us your views on these subjects Judge----

2. The senators know better.
They know as well as Roberts does that judges are not allowed to publicly comment on cases that have the possibility of being presented to them. From what I have read, the senators are even using a real list of cases coming to the USSC.

However, the senators can ask about past cases all they want. Or they could just come out and ask about his personal political beliefs.
