On Tuesday, the US Supreme Court
agreed to hear the case of Carlos Martinez Gutierrez, a Mexican who lived with family in Santa Clara County, California (where I live too!)
since age five and became a legal resident at age 19 in 2003. However, the US decided to deport Gutierrez after catching him driving across the border with three Mexican children. The Justice Department is appealing the 9th circuit court of appeals' decision to halt the deportation of Gutierrez given that his father has been a legal resident since 1991; otherwise, Gutierrez could not "satisfy the criteria that would have allowed him to seek leniency" (NY Times). According to the LA Times: "Courts on the West Coast have blocked deportation orders for some illegal immigrants because their parents had gained permanent-residence status and lived in the United States for more than seven years. Federal law cites these two factors as reasons for halting a deportation."
